I ETSed in 2016 and my 8 year commitment (3 years IRR) ended in 2019. I'm looking at getting back in but recruiter is saying that I would have to file an exception to policy since my contract would be 5 years which would bring me to 13 years if I somehow didn't get promoted. Does anyone know if IRR counts or not and specifically where in AR 601-280 it states what? (I've looked and can't find anything)

RCP only applies to active duty time. You'd still need the exception for a five year contract because that would exceed RCP for a non promotable E4

Coming back in your PEBD and DOR will get recalculated. So, RCP will not affect you. I know this because when I came back in with 10 years under my belt already, I didn't have to worry about RCP. That is, unless my Recruiter did you an ETP and I wasn't aware of it.
