Sorry but have to go with the rules and regulations are rules and regulations.
Even if you disagree with a regulation you are obligated to follow it.
(to compare oranges and pork chops....look at how many disagree with PT regulations but we still have to follow them)
That being said in this case I hope commander's discretion is exercised and maybe a stern letter or record of counseling is the max extent of any actions taken against him.

Thinks a terrible miscarriage of justice. This man is honorable and should not face charges but should be rewarded for his courage.
