While I have received a medical exemption from participating in ABCP after failing HT/WT, the regulation has a memo (reference figure 3-7) to request a medical evaluation to deem fitness to continue in the program.

Option C of this memo states “SM has a permanent medical condition that requires referral to an MEB or PEB”

To me, I find it redundant to need to get a medical evaluation if a soldier is already in the MEB process.

Do you believe there needs to be command guidance from MEDCOM or a policy change to prevent units from trying to involuntarily separate Soldiers who have conditions deemed disqualifying from service per AR 40-501?

No, because a Soldier can't be involuntarily separated once the MEB is initiated. Even if they piss hot, or fail every APFT, by law the MEB has to go forward until its completion.

I believe the guidance has already been briefed to commanders, but do not know where I read that information. Any one have anything different?

Yeah, my commander and 1SG were in agreement from their interpretation of the reg that if I fail the program (before I got the waiver) that they could separate me before my MEB finished
