Not necessarily MAJ Ken Landgren. VA disability rating is based on potential disabilities. I know of one man who has a 130% disability rating and he is still working because his disabilities do not preclude his line of work.
In my case I have been rated so far at only 80% disability but because of medications and their effects I am unable to safely drive long distances and because of other disabilities not able to negotiate stairs very easily or safely.

MCPO Roger Collins - Unfortunately I have Special Monthly Compensation (SMC). Mine is not that much but it helps. What sucks is the people that get a 94% rating. If they would get a 95% they would get paid as if they had 100%. Ratings stop at 100%. I have a rating for 100% and a few others that are over 40% and a bunch of 10%s. My final rating is 100% with the SMC which adds about $140 each month for me but I am pretty sure that SMC can got a lot higher.

SGM Steve Wettstein - To be honest I didn't know there was such a thing as SMC. If I needed it to provide for my family has would do whatever was necessary.

Hear is how it works, you can have your disability any where from 10% to we'll over 100%...if your at 70% or higher you can put in a claim for 100% temp un employable. With this you get the 100% disability pay but still will have reviews every 2 yrs. Or you can put in for total and permanent, you get disability for 100% but no more reviews, usually you are put in temp un employment first then after review and if your not getting better then they switch you over to permanent and total. If you are on any 100% , yes you should collect ssdi that is your money that you have put in, no government hand out.....it's yours use it... ..oo yea just because your total is 100% or higher the VA have a very weird number system the way they count so in less you put in a claim for 100% your not 100 you will be payed at 90%.

I suppose if you made it an issue. Even though I had a 10% disability, I was never asked about it. It would seem if you were otherwise qualified and they actually said that was a reason, there is a fair chance there could be a ADA claim made. Short answer is no it would not, at least on the surface. But, there isn't age discrimination either. (roll eyes)
