I served in OEF(2005-2006) in Haditha, Iraq. I developed PTSD, Sleep Apnea, Tinnitus, etc. Ive been denied Sleep Apnea and Tinnitus. Why?

Because the first step to establishing a VA claim is establishing service connection. It's not enough to show that you have these conditions, you have to show the service connection. Unless the issue is considered a presumptive condition, like lung cancer, you have to show that you developed this condition while serving. It's a whole lot harder to do once you are out of the service.

Considering your MOS a percentage for hearing issues should be a slam dunk. At the end of the day making any claim requires proof connecting you to a place and connecting your injury to that. I would check what documentation and medical evaluations you have in the system and validate everything is connecting. I would also recommend getting a sit down with a Veteran Advocate that can help punch up your request before re-submitting.

Yes, but the VSO seemed that she had no idea what she was doing, was not clear on what I should do or when to do it, and kind of just let me do it on my own with no help whatsoever. My main concern seems to be this "Nexus". If I could figure out how, and where to get one I think my claims can finally get rated.

LCpl Marvin Dames - Did you have documentation of hearing loss while in the service? Hearing Loss has a matrix score, but they only give you 10% for Tinnitus no matter what. I was out for ten years before I filed, but I did have copies of an H3 hearing profile, a copy of my last military physical and hearing test, and a DA Waiver.

I didn't file for Tinnitus until I got out, and don't have any documentation of a hearing problem while in service. I was diagnosed with Tinnitus by the VA and Rx Hearing Aides for Minor Hearing Loss, and I was rated at 0% for Tinnitus. I don't understand that.

0% is still a percentage which means it can always be increased later on. I would just submit a request to have the percentage increased and you will most likely go to a civilian clinic to have that done. My tinnitus was done after the fact too. The only thing I had was my 0331 MOS and me saying I have ringing in mr ears. They gave me 10%

Tried that, with no luck. I dont think they are Advocates in Saint Augustine that you can se in person thats willing to help.
