Having difficulties adding my stepchild to overseas orders. Spouse didn't remove her Childs fathers paternal rights, father has not been in the Childs life and refuses to have any correspondence with parent or child. Child was born out of wedlock. What do I need to do? Levy/orders office has been unhelpful with where to go or what to do?

Legally - you can't do anything. Your spouse has to take care of this. IF the other parent still has parental rights, she has to go to court and get a custody order (if there isn't one already). If the other parent refuses to answer any legal documents sent to him about custody, it might make it easier for her to get custody.

I think someone else had this similar question - so you may want to do a search. I just saw the very same question yesterday.

In the long run, you and your spouse may want to consider talking to an adoption attorney and seeing about you doing a stepparent adoption so that you don't have to worry about the sperm donor anymore. But as long as he has paternity established, he has parental rights.

Your spouse needs to talk to a lawyer.

You probably won't be able to this late in the game unless you have him sign away his custody and sign the passport application. You need to request a deletion of your assignment now before you end up spending several years OCONUS without your family. If you're not in contact with the other parent this will take too long to fix
