Do I need a misconduct waiver even if my category 3 "Major misconduct offense" was dismissed and there was no jail time served or a fine that had to be paid?
The police department says it was dismissed, the court said it was dismissed, and all I had to do was pay restitution (over$500 under $700) and complete 30 hours of community service.
I am prior service with an honorable discharge trying to go to commission. This stopped my packet when my back ground check came back. I understand the moral implications and I was out of the Army when I got charged.

There was a pre-trial diversion. If you are unfamiliar with the law, this means: if I did the community service and paid restitution there would be no trial and my case would be dismissed.
