Emergency leave was always confusing to me. If you have a death in the family, you have to use your leave days that you were saving up for a positive (event/vacation), for something extremely negative. You’d come back from a funeral only to have potentially no leave left and maybe even owe days, and get right back to the grind of work for months before you earned enough leave back.
To me It seems to me that in order to really take care of service members, emergency leave should be a block of 5-7 non-chargeable days in order for the service member to be afforded the time go home, bury their relative, get their affairs in order, and grieve with surviving family (if any). After that period, then maybe you could start charging the subsequent days.
I’ve heard horror stories of Marines that went home on e-leave, only to have their parents funeral delayed until after they were supposed to be back on base, and commands refusing to extend.
Do we know why the DoD has kept emergency leave as chargeable leave for one type of family-related event, but allows other family oriented things like maternity and paternity leave to be non-chargeable?

Leave is saved for all of the above. I have at all times 50 plus days. I take leave about once a quarter and it’s for the exact amount of days that I earned that quarter. You never know when you’re going to need a good amount of time off. I’d rather have them and not use them. A deployment really helps save up some good amount of leave.
Leave is basically what in the civilian word would be classified PTO (Personnel Time Off). It includes vacation, sick, bereavement, emergency leave etc. That would be a hard sell to tax payers to just give you time they must pay for above and beyond what we already get. Maternity leave is federally mandated it’s called FMLA.

That makes sense from a financial standpoint, but then perhaps it could be unpaid leave?

That doesn’t seem like a good reason to not constantly try and look for ways to improve the lives of your people.

Maternity and Paternity leave benefits were authorized by congress. If congress authorized all emergency leave to be unchargeable to your normal leave balance it would be so. Unfortunately, death related absences are not on the political skyline and are not likely to be granted. M&P benefits are an objectives some politicians would like to impose on all employers and they granted it to the military, which they control, as a benchmark in gaining the law necessary to impose it on all employers.
Just for information, in the civilian world, emergency death time off is most often granted as a contractual benefit and the length much shorter than you would suspect, based upon the employees' relation to the departed.
