How do I explain my hardship in a way that top will get me off orders?

Hello, I am currently in a situation where I have been on Title 32 orders (federal) since May 1st, a month back I was asked by the old team I was on if I would extend for federal or state or both, I said only federal orders and no to state, federal funding got disapproved and now they are putting me onto state active duty even though I said no to it, I have a business to run and need to look after my elderly mom not to mention I have been losing morale and started to feel depressed a bit due to living in a hotel room every day gets boring, how do I go about explaining theses circumstances to my upper command?

With these issues why is it easier to deploy Federallyvas opposed to state, your hardships should be the same. If you are looking for support, you need to come up with a better argument. Your hardships seem real, but again they don’t seem to change under either deployable circumstance, Sate or Federal.

Fema had got declined and I reopened my business told my mom that I will be coming home August 7th so I can take her to the hospital for her foot as she wont go in without me and she has waited since may, switching to state is something that will be a huge change within my life as I will need to close the business again and hope that my mom will go in for her foot without me due to it will most likely need to be cut off by what a nurse had told me months ago, and at the moment since I hadent got my business running fully yet given I cant have it open while Im gone at the moment, I am still paying all my business expenses for the website, Distributors for supply which I was fine with given I was getting the extra pay and benefits on federal so I could pay for it all and still be able to pay my rent and food on state my BAH gets cut in half so I will need to come up with the additional funds for the rest of my rent

PFC (Join to see) - Yea, you need to quantify your financial duress, medical need, or family emergency. There is also a forward thinking concern your commander might have. In the event of bigger picture mission needs in the case of a major military need are you able to deploy at all. If that's the case, maybe you should line your ducks up to get out entirely. Getting out of orders like this shouldn't be all that hard. Getting out of a major deployment, this excuse wouldn't fly. In that case, what are you doing in the NG/

Why are you willing and able to be mobilized/stay on orders federally, but not state?
How is the difference a hardship?
What will happen with your business if you deploy for a year or more?
What will happen with mom if you deploy ? Have you set up a family care plan?
You need to speak frankly and honestly with your chain of command. And you will need to (like everyone) evaluate your situation when this enlistment is ending to determine for yourself if you are able to continue to serve.
One of the hardest things I had to do was have that conversation with a great troop, whose business situation would have bankrupted him with a deployment. He ended up having to separate at the end of his second enlistment.
He loved serving, but there was no way he could deploy and that wasn’t fair to the rest of a 100% mandatory deplorable unit.

Reason I am willing/able to stay on federal orders is I will be making enough where I can pay all my bills for my business and personal life, the difference is a hardship due to the fact that I will be needing to find a way to pay the difference for the bills I owe on, My mom refuses to go into the hospital without me for her foot which a nurse months ago had said will most likely need to be cut off so I told my mom I would be back Augest 7th and that I will take her to the hospital and be by her side, I do not have a family care plan setup as of yet, I really love the military and enjoy serving my country but I told command I could not do state and they said they were fine with it I would be pulled off mission if fema did not get extended then they changed their mind so now Im stuck inbetween everything.

I see. This is definitely something that you need to have conversations with your unit about.
As a troop, it is hard to grasp that sometimes guard units (unique to guard units) get tasked with state missions. Sometimes we have the luxury of not taking those orders sometimes not. You as a troop won’t always be able to cherry pick, sometimes you’ll have to suck up the less desired orders. I get that this causes hardship, which goes back to evaluating ability to serve.
Be honest with them. Have documentation to be able to demonstrate hardship. Maybe they can help out, maybe not.
And while this is tough pill to swallow, your hardships while huge to you are in many ways very likely the same as the hardships of many of your fellow guardsmen.
Also, as you are moving forward, everyone has temporary issues (everyone). Keep your COC appraised of what is going on in your life and they can work with you where possible. Bring it up after they tell you that are being put on orders and it becomes a tough sell.

PFC (Join to see) - Many of us here don't know the financial difference between State and Federal orders. I remember states being so bad with money that the NG guys in Basic and AIT were getting screwed depending on which state they were from.

Talk with your NCOs (Squad Leader and Platoon Sergeant). Tell them your situation. Then ask them to go with you to speak with 1SG and lay it out on the line just like you did here.
