I have been in con leave since December 27th,2019. It was my second surgery on my tailbone Ive had in the past 6 months. My wife is also pregnant at this time, and she is barely working. So I(and my docs) we’re anticipating that I will be healed up by March- April. So I posted on social media(I understand it was a stupid move by myself) that I’m looking to detail peoples cars for money, to earn some extra money since I am now picking up all the bills in the house hold and trying to put back for our little one due. Take in mind, I have not worked, I have not done anything while in con leave. This was just a eager move to some extra cash for myself and wife. Well I got pulled off con leave for this, and was informed they will be giving me a chapter 14c on the post I made on Facebook on how I can detail cars for people in March or April. My COC believes I have been working this whole time, yet I have not. They believe I have also been collecting a paycheck besides the army’s, while I definetly have not been. And they also have no proof besides a Facebook post that was a picture of my wife’s car stating I can detail cars. So what I’m asking for is advise on how to go about this situation? Thank you.

We also were supposed to PCSing in June since I re-enlisted.

Let me see if I am understanding this:

You are Active Duty
You had surgery
You are on Con Leave
You are earning pay while on Con Leave
You had surgery on your coccyx (tailbone) twice in 6 months
You posted that you can do work that requires you to bend...sit...twist...things that would/should irritate your coccyx

Is that about right?

SPC (Join to see) - You need to show as much proof to your Command...and your JAG Rep....that you did not intend to bypass the system (as it were) nor be guilty of misconduct. If showing bank statements and the conversations can help your case...then use them. It doesn't matter that you've seen other Soldiers doing wrong. You still need to do right. You need to convince your Commander that you had no ill intentions and that you had valid medical/financial reasons for your actions. You SERIOUSLY need to convince your Commander of this. And if you can get your NCOs to stand up for you/next to you and state the same thing....your chances may improve. If you do manage to beat this....follow the straight and narrow true path. There are financial assistance programs to help you. Talk with your NCOs. That is what we are here for. To assist our Soldiers. We can't help you if we don't know what the problem is.

Rgr SFC. I plan on doing so, I didn’t mean no wrong or intent. As I am still trying to heal and get back(as I currently am back now) and back to what I was doing before. This all originated as I was trying to go to selection and couldn’t clear my phase 2 because of this cyst on my tailbone. Then, wife became pregnant, stopped working as much and I’ve had to pick up everything since.

So I’ll try to do as much as I can to prove I’m not/nor guilty of this.

SPC (Join to see) - listen, I get it. I really do. You are facing a mountain of stress. You've become the sole bread winner. A little one along the way. A wife not working. More going out than coming in. And that ALWAYS hurts. Besides doing all that you can for your case, you should also seek out your nearest COSC/Behavioral Health and speak to someone about your stress. It can't hurt. Trust me on this one. On this, I can speak from personal experience. There is no shame in seeking help.

PFC Jeffrey Herrington - Oooh...I was wondering that, as well. That being the case, I was simply trying to give advice and guidance for the current situation. But yea, there is some hinkyness going on.

Look, it was stupid- 1. Go to JAG- you have to prove you didn't work- hearsay won't help. 2. They will have to prove that you did work. 3. YOU MUST HAVE permission to work a second job PERIOD! It is going to be hard, maybe you can get your ducks in a row and win.

I hear yah sgm. Like said, I know it was stupid move by myself. My 1sgt even told me that I should have came to them if I needed help, or to get promoted. I’ll be headed to jag soon, coc keeps tasking me out since I’m back at work now. But I will be headed there soon.

And I’m hoping to win, as I have a child on the way, I have no desire to be exiting the military. It was a stupid mistake by myself and I’ll own up to it. I just won’t own up to for being falsely accused. But, thank you sgm.
