Can you use a DD368 Conditional Release for Active Duty to National Guard or Reserves?

Hello All, I recently submitted a DD368 to be released from Active duty to National Guard. I submitted this due to my spouse threatening me with divorce and keeping my child from me. It was been a huge burden on me financially and mentally. For months I have been taken advantage of and my son has been used as a pawn to collect money from me. Does anyone know of this is something that can actually be processed? Both battalion and brigade retention NCOs have advised me that it’s not a real thing and that if I want to get out to “fail my APFT”. I was a bit surprised to hear that from a E7. I showed him the DOD instruction showing that this form can be used to transfer between components. For the hell of it I asked if I could switch branches that would allow me to be closer to my son and he said it won’t happen. I do not want to get out because I legitimately enjoy the ARMY. Who would have to approve this? If anyone has any information for DD368 I would appreciate it. Thank you.

No, you cannot use a 368 to go from Active to Guard/Reserve. It can only be used for going from Guard/Reserve to Active Duty.

PFC (Join to see) - I was looking in AR 635-200, Active Duty Enlisted Administrative Separations, in Chapter 6 for Hardship Discharge. Reference this and get with your CoC and Retention NCO to see if you fit the bill for this. The caveat is, is that you (if you qualify) may be fully discharged and would have to seek a recruiter to re-enlist back in for the Reserves or Guard.

Hello Sgt. , I have sat down with them and unfortunately my situation is not grounds for a hardship discharge. Retention said either fail my PT test or wait until ETS.

PFC (Join to see) - I don't recommend you fail APFT nor HT/WT. I recommend you wait until your ETS and then transfer to the Guard or Reserve. Also, I recommend you and your spouse speak with a marriage counselor and/or a chaplain.

No. It doesn't work that way. No one can approve it. It doesn't matter if the Division Commander signs it for you, it will not allow you to separate from the Active Component. All the ways for separation from Active duty are in AR 635-200
