SHARP INVESTIGATION occurred on one of my soldiers and he is not flagged. It is a bullshit investigation that comes from another NCO that accused him of sexual harassment for a verbal statement that he made to someone else in the army and never to her. How long do these investigations last? What are the chances he will get in trouble? He admitted to the statement and he made it to another soldier but never to her and she only reported because the one he made it to is her boyfriend and they are being investigated for fraternization. My soldier has never been in trouble and he is solid in performance. The investigation began end of October.
How long do these investigations take? It has been closed but it is at legal for the last three weeks? Also he was never flagged for the investigation and never given a counseling for it but it is still under investigation. Should he have a flag put in place for this?

It sounds like you need a SHARP class if you believe it's BS for a comment to be ABOUT someone and not directly to them. Making comments behind someone's back is even worse because it robs the person of the opportunity to defend themselves..
Yes, the Soldier was required to be flagged for investigation. The flag prevents him from leaving before the investigation finishes. It's not a legal investigation, and not something that would be handled by CID so it only takes asong as it takes the investigating officer to compile everything. As for what will happen to him, it's just a comment and nothing illegal (rape, assault, etc) so it would fall on the Commanders discretion.

Sgt Jose Vasquez sure whatever you say. You seem like the kind of guy who is going to get your company sued for sexual harassment because what the Soldier described is in fact sexual harassment and hostile work environment - which is why we have these classes, because people don't realize it is.
You've made a lot of assumptions based off me answering the Soldier's questions and explaining the regulations to the Soldier. In fact, if you look through these forums you will see I spend my spare time helping Soldiers with problems when they hit roadblocks at their units or with their leadership. But hey, you're better than old veterans because of your "several times six figure salary". I imagine some crappy leader made you feel small in the military and now you get to spend your time surfing the internet bragging to people you've never met about how rich you are.

I dealt with a racist sergeant who tried to set me up with a false rape charge and fraternization because I was dating a white female Marine, and old country boy from the south couldn’t stand all that evil race mixing. Now I get laid all that I want without having to worry about if its appropriate to racists and losers with more stripes then me. And yep, that definitely left a chip on my shoulder. Nothing came of it, because the girl simply admitted she seduced ME, and I wasn’t even in charge of her anyway. I was simply lucky she wasn’t a crazy one. Also I gas a sane Mastery Gunnery Sergeant who was a 24 year vet, half korean and had also dealt with racism when he was my rank.

SFC (Join to see) I don’t sexually harass anyone and I purposely work with mostly males in a skilled trades environment so that I don’t have to play these stupid modern politically correct office culture games. Even tho I’m the actual minority in my career as a Latino male, I’d be viewed as an evil white male by HR. No thanks. Happier getting my hands dirty and having actual freedom. I rarely cuss or say anything to crass at work, but one simple comment nowadays can destroy you anyway. It’s ridiculous. i can tell you’re the office rule book guy tho. You’re just way too enthusiastic about these stupid rules. You’re a BOB and a POG for sure.

Sgt Jose Vasquez The Master Guns helped me deal with that racist POS. But yea, i hate people that abuse stupid rules to screw over innocent people. And people that are Yes Men. No original thinking, just burn the junior troops by the book. I hate working with people like that. I follow rules and don’t harass or deal with women AT ALL at work if I can help it. HELL NO I’m not getting #meToo-ed over some total BS.

It sounds to me as if they are doing a Third Party Sexual Harassment complaint. Just because the comment was not made specifically to a person does not mean that they cannot be offended by it and report it. I was stationed at Ft. Sill from 97-00 and was in HHB 3/18 FA. As one of the only females within the BN, I was always being asked if certain comments offended me. One of our mandatory classes were on Sexual Harassment. We were told that all someone had to do was hear a conversation between other people, and if a comment offended them, as a third party not even participating in the conversation, they could report it under the Third Party Sexual Harassment rule. I personally don't agree with it, but I have seen many females hear part of a comment between two males within earshot and holler Sexual Harassment. It is the stupidest thing that I have ever heard of but it is regulation.
