Which concern veterans that are some type of bankruptcy and are using their disability to pay back debt. This Law suppose to stop all use of any type of disability payment to be uses.

It eliminated an unintended categorization of disability compensation as "income". So that means it doesn't count when filing say Chapter 13. Social Security is not income either. The end result is it gives a small bit of breathing room and stretches out a payment plan. That presumes there are not sufficient assets to go with a straight Chapter 7. Calling it "Haven" connotes something more than it really is. Unfortunately VA disability is pretty much inadequate in the grand scheme. However it's a Godsend if there isn't anything else.

The law was just enacted in Aug. If you are discharging a bankruptcy from prior to that date you will probably need a lawyer to modify ask the court for a modification. If you are currently undergoing a bankruptcy then it should not be included in your disposal income and the court should be aware since it applies to many types of disability not just the VA.
