Damn skippy. Leave is not a right, it is a privilege. You don't get privileges if you fail to meet the standards.

CW3 (Join to see) - you wouldn't mind then citing the passage of the aforementioned AR in which it defines leave as a right because the good major said the exact same thing about AR 600-8-10 and it was nowhere to be found.

Even though you're being a complete ass, I'll be nice and do it.

2-3 a. Soldiers on active duty earn 30 days of leave a year with pay and allowances at the rate of 2 1⁄2 days a month.

Something you earn IS a right. Plus, you can only accumulate leave up to a certain point before it becomes use or lose, and if a soldier is in that position too often, the command gets looked at.

PASSES are a privilege. Leave is a right, and can only be postponed due to operational constraints, not denied outright.

You don't earn passes, you're granted them. Leave is earned.

Your attitude means that one of the most stressful jobs in our country can never have vacation.

CW3 (Join to see) I earn a paycheck at a job. Is that paycheck now a right? Just because you earn the leave days does not mean that taking leave is a right.

I really enjoy all of the convoluted half argumentsbeing attempted over this issue while none of you can provide a regulation to cite that provides an answer in line with what you're attempting to push. You're wrong. Plain and simple.

Seeing as this comment is only seven days old I will contribute. Leave is absolutely a right and has been recognized as such but none other than Congress. As has also been said, the commander does have the discretion to determine when leave can take place. I'm a little confused why a soldier would be denied leave during a period of time which was established for taking leave, unless there was a range during this block, and a deployment very shortly afterward.

The scenario you just described as to whether or not a paycheck is a right is also very troubling. You do understand that a scenario where someone performs labor but is denied their wages can really only occur under UCMJ punishment, and also this system we used to have called slavery? Yes, a paycheck is a right and you have a fundamental misunderstanding of rights versus privileges .

Young SMs today should focus more on their job and meeting minimum requirements than what their NCOs/Leaders cannot cannot do. Meet the standard! PERIOD. Do that and everything else falls in line. Don’t do it and you’ll find Military life pretty difficult.

True. They can. However, the command and the Soldiers leadership had better be scheduling retraining and more ranges to give the Soldier more opportunities to qualify. If not, then that is a pretty crappy command who are not doing the Soldier justice.

Absolutely. If a commander sees fit he can Deny the block leave for any soldier in his command. Does it happen for not qualifying on a range I never seen it but if your First line leader denies it chances are the Commander will go off the recommendation from your Psg and 1sg.

Leave is a right. You earn it. Plus if it is block leave then it can not be denied just for failing the range. Because it is blocked for the whole company or BN. If it was not block leave then yes it can be denied.
