Will the VA freeze/declare a debt owed for my getting separated and going for commission?

Does anyone know whether or not SM's who are attending Green to Gold (Hip-Pocket) who have also extended their enlistment contract to give GI Bill benefits to spouses will be penalized under the failure to complete service obligation from the VA? I have been fully accepted into ROTC/University and the final step is the award letter. My wife has 14 months of benefits for Nursing school. To be more clear, will the VA freeze/declare a debt owed for me getting separated and going for commission?

That's a lot of unanswered questions. You said hip pocket program, so are you on the active duty G2G? In which case you're still serving. Did your wife use 14 months or did you just allocate 14 months to her? You don't have to be enlisted to transfer, only serve. If you're a scholarship cadet you're under cadet command and not serving. If you're non scholarship you can do SMP. There is a section at HRC who approves TEB and they will be the ones to process your exception to policy, not the VA.

Thanks for this answer and guidance, the hip-pocket scholarship will separate me from Active Duty August 24, 2018 once my orders for ROTC are generated and put me under contract with Cadet Command, so not serving as you said. She has used something like $32,000 worth of eligibility and graduates at the end of the year, but it will end up totaling $44,000.
The VA has also notified me of what you said as well but did not provide the information about the section at HRC that can process an exception to policy. I will dig further into finding an answer through HRC.

If you are continuing in the service, just at a difference rank, why would the VA care?. You think O's don't go to school using VA benefits? Check with the local VA.

I had the same thought which is why I started with the VA but they are pointing fingers at the Army. Ultimately it's up to the Army whether or not they will process an exception to policy for me. Either way, thank you for taking time to provide your input.

My gut reaction is yes, if you extended for that benefit and didn’t complete the terms of your extension. However, def talk to the VA and get everything in writing.
