Approved LOD's what good are they when given to a Reservist?

What good is an Approved Line of Duty and Da Form 199 for a Reservist if the VA will not except it. The VA Reps only look for the words ACTIVE DUTY, anything else is ignored and not seen as Service Connected.

Here is an example though my concern is for all who receive an LOD. I was retired after injuring my hand tho this was not the only reason. I was given an Approved LOD for the initial issue of my injury thought to be only a sprained finger only to find that it was a major injury requiring major Surgery by the VA hand surgeon. I asked what am I supposed to do with the LOD and was told to take it to VA to file a claim. I filed a claim only to be Rejected by the VA as non service connected because it did not happen on ACTIVE DUTY. It did not matter that I was on duty/ in uniform when it happened. Now after surgery I no long have full use of my dominate hand. The Surgeon stated I would be lucky to get back 50% which has left me unemployed because I do not have full use of both hands. The VA and it's VSO's do not want to touch the claim because I was not on ACTIVE DUTY at the time of injury. So I asked what good does it to to give a Soldier an LOD if the VA is only going to reject it. Hope this helps.

Ok now the real issue is forthcoming indeed.
1. When did you get the initial injury? mm/yyyy
2. Were you in a drilling status at the time of the initial injury, and was it in the performance of your duties because of said injury?
3. Documentation regarding the initial diagosned injury from medical hospital? Do you have it still?
4. at what point did you/VA decided that you needed surgery, and where is that documentation currently?
5. You stated in your response that "You were retired after injuring hand" but was given an approved LOD PROR TOO? Do you still have this documentation?
6. Sometimes it takes an extra pair of eyes and a fresh perspective to get the ball rolling again.
7. Lastly is this VA claim still open for backpay purposes?

So did you hurt your hand around the house, basketball, something like that? If this is the case, no LOD would apply. The person that gave you LOD paperwork did not know what they where doing. If this happen on the job like in the field or on a truck it's different. LODs deal with money and are documented closely by the unit and higher. An LOD is not just one form. Sworn statements are needed, medical documentation, along with a few other things. Seems to me that someone was trying to brush your problem away from them.

Your unit is doing it wrong. Other than the VA being the headache it is today an LOD works at all medical facilities if filled out the proper. Also if deemed that you will be out of work you can fill out the forms for ICAP pay to cover medical bills and workmans comp.
