Spirit: we are going to end up bankrupt and out of business if we do nothing. So we are selling to JetBlue.
DOJ: That leaves gaps in low cost routes, we won't allow it.
Spirit: If we go out of business, those gaps will still exist. Plus, most of them will be covered by other low cost carriers.
DOJ: We can't allow it. It would make JetBlue too competitive with the big 4. Oops, I mean it is anti-competitive.
JetBlue, It literally eliminates no competition and it INCREASES competition in the major markets.
DOJ: Exactly.
Judge: Exactly. Denied.
