While all state constitutions mention U.S. citizenship as a requirement to vote in state elections. In 46 states, the language says who can vote (e.g. "every citizen"), but does not explicitly state that noncitizens cannot vote. In 4 states (Arizona, Louisiana, North Dakota, and Ohio), the state constitution directly states that only citizens can vote.[1]
However, despite the state constitutions the District of Columbia and some municipalities in California, Maryland, and Vermont do allow noncitizens to vote in certain local elections.
Given the historical actions of the current immigration activities and Mayorkas ties with the leaders of both LUPE and Angry Tias & Abuelas, according to documents obtained by Judicial Watch, a government watchdog, it's a consideration to mitigate the risk.
Federal law bans foreign nationals, or non-U.S. citizens, from voting in federal elections.
Sanction
On Friday, former President Donald Trump endorsed proposed legislation by House Speaker Mike Johnson, R-La., that would require proof of citizenship to vote in U.S. elections. This of course will not pass the Democratic Senate.
