In Summary: A court in the US has ruled that civil restraining orders cannot infringe upon the Second Amendment, which is the right to bear arms. The ruling, made by the Fifth Circuit, found that the 1996 Lautenberg Amendment was unconstitutional. Judge James C. Ho wrote a concurring opinion, saying that if someone is too dangerous to have arms, they are too dangerous to be on the streets. The Biden administration has not yet appealed the decision to the Supreme Court of the United States. However, the administration has asked the Supreme Court to fast-track a case that could reinstate a federal gun ban on people under domestic violence-related restraining orders.
