If you as a service member did or were part of something while you were activley in uniform, you can be brought back on active duty and tried under courts martial. I don't beleive they can bring you back for pst retirement or seperation actions...may be wrong but I don't thin the UCMJ has that much reach.

Lt Col Scott Shuttleworth - That's the who point of his appeal - DoD absolutely can do this to active duty retirees (not reserve component retirees, although the Fleet Reserves is a notable exception) as the law stands now.
