This is a very interesting article. It reminds me of a story I recently read where the moral ends up being, people will never notice or credit you for what you do right 100 times, they will instead ever only focus and criticize you on the one thing you did wrong..

It happened to my S-2 in Iraq at the front gate and he got a $600 fine and humiliation from the Battalion Commander. Not sure if he got a bad fitness report/ referred OER over this.

Remember that Court Martial can include "investigation" as well as "Punitive."

I just had my guys drop the magazine and keep pulling the charging handle to the rear three or four times. If rounds stopped coming out, the Soldier could go ahead and pull the trigger. If rounds were still coming out, then they obviously he/she didn't drop the mag and that Soldier would have a discussion with his/her TM LDR. No ND's once this was put out.

Pretty rookie move for a SF, and a SF commander. I do admire his integrity. I also hope that he's punish according to the crime, not the rank. The article stated that they had over a 100 accidental discharges last year, so there should be plenty of precedence.

LTC (Join to see) - I've seen plenty more and more severe brushed under the Carpet, They would be Relieved of Command, Maybe, Maybe Not a Admirals Mast (Article 15) rarely a Court Martial. The best rule of thumb I would use that if you did something that caused an Oprep-3 Navy Blue (Incident Likely to Bring Press Attention and Diplomatic Problems with the Host Country) Your Career is Over. Another rule of Thumb if your ship is run aground or seriously damaged, The CO, XO, OOD and Navigator are Fired.

LTC (Join to see) - Also the Military has always been as Political as any other Organization and if you pissed off enough folks on your way up the ladder when you get in a pinch they will all pile on to end your career. Think of Richard Marcinko. The same thing that makes you a super Special Forces can also make you Red Meat for others you left by the way side.

I guess in the Army, the old days, of drinking in the tank are over. That World War II veteran I did a story on had a negligent discharge after VE day and he shot his best friend in the thigh with a .45 and all that happened to him was his commander took his pistol away and nothing was done. He met his friend later stateside on his preparation for the Invasion of Japan but the next day Hiroshima was A-bombed.https://www.rallypoint.com/answers/anyone-have-any-more-ww-2-veterans-stories-that-they-can-share-here

PO1 William "Chip" Nagel - I did not report this in the original story since it was embarassing. I also had to cut it down to put in my Brigade Newsletter.

Well that is just stupid LTC (Join to see). While I agree with what the General said, “As a soldier and as a special operations assaulter, the only acceptable standard of care with a weapon is error-free.” accidents do happen. I do not believe he should be facing a court martial. I think that is over the top.
