Judge Tees Up Fight Over Gitmo Court's Independence
MY SAY: Nobody has gotten anything right about Gitmo detainees ever. Wrong, wrong, wrong! In 1942, 6 of 8 German saboteurs caught dry-foot on US soil were denied habeas corpus, tried by military commission and then EXECUTED, all within 8 weeks of their capture. Oh, and none of them hurt a fly nor damaged or destroyed any property; they were convicted of having the means and intent to do so as unlawful combatants. What's different now? Obama's 2009 Military Commissions Act, which gave Gitmo detainees accused of war crimes virtually the SAME rights you or I would get in a federal court of law. The 2009 MCA usurped the UCMJ and Geneva Conventions, which offer no rights or privileges to unlawful combatants or spies. If we revoke the 2009 MCA and then use the UCMJ and Geneva Conventions, justice could finally be served.
