Yup, it sure sucks. I didn't follow the trial and don't know all the facts of the case, but to me it comes down on whether or not he was negligent.

I don't know all the facts in this case. I do know, as a young trucker, early in my short career in truck driving, I learned a very important lesson.
Heading home with a full possum belly trailer of horses, I had tonegoriate Black Mt. NC. I thought I had selected a low enough gear for the descent, but I was mistaken. Horses have a very high center of gravity, they like to lean. My brakes were smoking badly as I was coming down. I decided if I couldn't stop the truck prior to the escape ramp, I would take the ramp. Thankfully, I got stopped at the ramp, I pulled up beyond it and sat for 45 minutes to cool the brakes. 2 other truckers joined me at the ramp for the same overheated brake problem.
Lesson learned, I didn't panic.

Until YOU are in that place of panic, just like the sheriff or policewoman on trial, you don't know what you'll do. Terrible accident.
