The fact that the assistant director handed the gun to Baldwin is a huge red flag. The armorer (a new term for the old "gun wrangler," in vogue since the Jason Lee killing) should have complete control of firearms and ammunitions of all types. That is their only duty. In the Lee case, several people handled the gun after it left the armorer's hand, and in this case at least one did, and that one passed incorrect information to the actor.

This was a low budget film, so presumable the same mistake was made as on the production of The Crow, in that they hired a minimally qualified (if that) gun wrangler/armorer to save money.

The keep saying it happened with a pellet gun.... What kind of a pellet gun will kill a person?

You would be surprised...some of the pellet guns on the market today are tough and a well places shot is almost as deadly as a .22.
