I agree, congress should decide this and a lot of other things. However, congress has had years to make a change and failed to act.

This is an archaic law that has no logical basis anymore, let the Supreme Court deal with the case and then congress can and should pass a law anyway. There's nothing that stops them doing that, it's their job.
