As a private citizen I believe he maintains his first amendment rights. On the professional sites I use we can flag and explain our view of a harmful and threatening message and the site managers are then responsible for any reaction from there.

Remember the First protects from government suppression. Private companies are free to give you the boot if you violate their TOS.

The question I have is...when will we move into the 21st century and realize that the chat on Facebook and Twitter represent the Town Square of 1800, the Public Sphere today. When will the US recognize the freedom of speech we ALL must have as part of a democratic republic? We need to change the law to control the monopolist holders of the public sphere...or Facebook and Twitter may find YOUR voice may not be heard. Legally change their TOS to a service-provider only, just like AT&T or Verizon. They provide the network SAAS and stay out of content altogether.
