Well presented explanation. When courts begin deciding "what might be", we are in trouble

It was still a disappointing decision, because the SCOTUS had the opportunity to limit legislative and regulatory overreach, but they just punted. It really invites other jurisdictions to push the limits, knowing that they will probably get away with it, at least in the short-term, because it takes a while for challenges to work their way through the courts.
