Mitch McConnell could fix this with a simple rule change. You can’t blame the opposition’s tactics when the ball is in your court and they are on a winning streak.

Capt Gregory Prickett This is what I was referring to.

“In the Senate, a blue slip is an opinion written by a Senator from the state where a federal judicial nominee resides. Both senators from a nominee's state are sent a blue slip in which they may submit a favorable or unfavorable opinion of a nominee. They may also choose not to return a blue slip.”

SSgt (Join to see) - I mean no offense, but you've verbatim said that like 4 times in this thread. What exactly are you trying to say?

Did you ever give it a thought that perhaps the reason the courts blocked his orders was because what he was trying to do was either unconstitutional or illegal?
Was he elected President or King?

We have 3 branches of government for a purpose.

Checks and balance.

Yes, I have given it a lot of thought. Last I heard, the 3 branches of government were Congress, Office of the President and the Supreme Court. Since it takes 1-2 years to make it to SCOTUS and SCOTUS is starting to reverse the rulings of the 4th and 9th District Courts I would say the article is pretty spot on. The District Courts were never meant to be in a position to deny POTUS EOs. They are REGIONAL in scope and are making decisions at the NATIONAL level.

"...Barack Obama’s Justice Department pushed back against the practice, arguing, 'A trial court abuses its discretion by fashioning an injunction, which is overly broad.'" Since no laws were put in place to prevent this the left leaning courts have filed more injunctions in 2 years than the total filed for the first 200+ years of our history. This is called over-reach in my book.

To add on to the example, if you were to file a suit in your local city court against a Presidential EO and won, would you expect that court to issue an injunction at the NATIONAL level as well?

"The Supreme Court has a special role to play in the United States system of government. The Constitution gives it the power to check, if necessary, the actions of the President and Congress.
It can tell a President that his actions are not allowed by the Constitution. It can tell Congress that a law it passed violated the U.S. Constitution and is, therefore, no longer a law. It can also tell the government of a state that one of its laws breaks a rule in the Constitution." https://www.scholastic.com/teachers/articles/teaching-content/role-supreme-court/

No where have I found a reference to extend this right to the Federal, State or local Court Systems.

Nope it is just the left being obstructionist by filing mostly baseless claims only in judicial districts that will support their claim. And if you read the entire article even Obama file complaints that lower courts should not be able to make a blank nation wide decree, it should actually have to make its way to the supreme court, but wait so far 90% that have made it to the Supreme Court have been over turned.
