To listen or read those that criticize Roberts, accusing him of legislating from the bench needs to understand when you rule to uphold a law or against it as your duty as a judge or justice then you are in fact enforcing rule of law by setting precedent.
These allegations that the judiciary is writing laws (legislating) from the bench is ridiculous.

Only the Legislative Branch can make laws, enforcement of existing laws falls on the Executive branch but they can't make laws, they haven't that authority nor is it their job. The courts would be the branch to determine if acts are in violation of written laws or in compliance provided the offense was within their jurisdictional area in the Case of US District or circuit courts. Overall the US Supreme Court would be the final authority if for instance if its a constitutional matter or question on other points of law. When members of any of the three branches wanders from their powers its up to the other two branches to put that problem in check. It seems to often that is forgotten although its not a new problem which is why things were set up the way they are by our forefathers. From time to time it seems public officials have to be reminded and reeled in if they exceed the authorities of their office. That applies to all three branches of the Federal Government.
