California does not claim the embryos as its own citizens. It is only the particular jurisdiction in which the old boyfriend filed his lawsuit in order to take advantage of local law treating embryos as citizens - in which a local judge said for the purpose of Louisiana law they are California citizens. But, then again, you have to remember Louisiana practices Napoleonic Law - the old French law - where you are guilty until proven innocent - where the rest of the country practices English law - where you are innocent until proven guilty - and embryos are not the citizens of any one state.
