The reg said my wife&#39;s anability to take care of herself led to this. Yes, I had said previously that she was waiting to be put on EFMP, she is now. Whom determines the &quot;inability portion?&quot; Is it the chain of command or legally speaking a specific disability. She is not legally disabled. <br /><br />Also, I had worked around the regulation. My COC had not really cared much about my workaround. I had not initiated the FCP so as to send my wife home temporarily as to avoid needing one. <br /><br />When the COC did the 268, TDS denied it because I sent my wife home, and there was no evidence of my wife&#39;s inability through my Counselings. <br /><br />So about two months later, the initiation of my flag removal happened. 4 months later down the road, still having trouble removing my flag even after submitting three new 268 with a DA 200. <br /><br />Any reasons why it&#39;s not off when we&#39;ve done everything we could to lift it. TDS didn&#39;t deny your flag because TDS has no authority to flag, unflag, or stop you from being flagged. Otherwise, you wouldn&#39;t be flagged.<br /><br />If you feel you are erroneously flagged, then you should talk to IG. They can also answer your questions about who determines what requires a family care plan. This is exactly what their job is for. Are you in a Command position, which I find difficult to believe since your listed rank on RP is SPC/E-4?<br />A DA 4187 Form is used by US Army soldiers to request personnel action, which is what you need to file AND regardless of your desires it is a request, not a Command. Your CO is the one who decides to give and is the only one who can remove the flag. You said that medically she couldn&#39;t get a license, so she couldn&#39;t drive and you had to drive her everywhere. So YOU said she was unable to care for herself in that aspect. Which &quot;reg&quot; are you citing about &quot;inability of care?&quot; <br /><br />How did you &quot;work around&quot; the regulation for FCP? <br /><br />TDS doesn&#39;t have anything to do with flags. This post is just as confusing as your first one and with equal the amount of attitude honestly.<br /><br />Also EFMP is only for people with medical or special needs - an inability to care in any aspect would be a medical or special need. Especially if due to medical needs. EFMP is there to help those with dependents who have any specific special or medical needs to accommodate them and allow the soldier to be stationed at a place that person&#39;s dependent can get the right care. <br /><br />You were flagged for not having a FCP. If you no longer have the need for a FCP, your commander should have just submitted to S1 to lift the flag. None of what you&#39;re saying makes any sense. Last time I checked if there were any communication errors with your Commander and S1 the Commander would be cutting off the OIC or the NCOIC’s head for not responding to his communication’s. I have a feeling it isn’t a communication issue but a Commander issue. Knowingly “Getting around or purposely using” any Military regulations is punishable under the Uniform Code of Military Justice. The regulations are for every soldier to follow no matter what.<br /><br />Now as for the family issue you are experiencing is this new, on going, or something new medically with your spouse? I have seen a few situations over my many years in the Army (not this confusing) where the Commander did one of a couple of things; send the family home as the Army is not in the business of accommodating a Soldier to stay around just to care for his/her family while all other soldiers are doing the job they qualified for or begin a separation either for the “Good of the Army” or a flag in order to get the soldier to find suitable sources to assist with the care of the family so it is not interfering with Military operations. More often then not a flag is only reviewed 3x before formal separation for failure to repair is initiated. You seem to be lucky with 4 plus reviews and are still on active duty.<br /><br />Now as for advancement for the higher rank ( not to be hateful ) why would a Commander recommend a soldier for promotion when he/she has so many issues plaguing the soldier/Command when there are probably other soldiers that are as qualified and without all these issue/s? Please take the advice of many here and request to see the Company Commander about your situation. Yes the Command/Commander are there to take care of their soldiers but also they are in there to protect the interest of the Army. <br /><br />Just a thought.
