These all qualify him as a helpless child but every time I apply for the dependent rate it is denied. He relies on me completely for his day- to - day activities and I&#39;m responsible for every day needs. Why if I'm at 60% disability & have a helpless child who's 28, and I'm the guardian of, does the V A refuses to give me a dependent rate? 2020-07-21T03:23:37-04:00 SSgt Private RallyPoint Member 6122173 <div class="images-v2-count-0"></div>Have court documents stating he&#39;s an incapacitated adult, he receives SSI, Has been disabled since childhood, and had an IEP since the age of 3. I have special needs Daughter. As soon as my Wife and I got Guardianship and my daughter got SSI, part of her SSI payment came out of my disability check. When she turned 21 it changed. I started getting Social Securty because I retired. So I get mine and now she gets her own Social Security. It&#39;s all so confusing. If you call and ask questions, it&#39;s like you got the wrong number an got China. Because it sure sounded like Chineese to me.
