When a superior officer suggests to doctors that his junior may be psychotic or manic for submitting an IG complaint, is this reprisal?

A junior officer was committed to an EMHE by his Commander based upon the fact that the junior submitted an IG complaint earlier. The law under Section 546 of Public Law 102-484 (1992) prohibits the use of MHE/EMHE in reprisal against uniformed service members and DODD 6490.1 and DODI 6490.4 strictly prohibits the same. However, this violation of the law is allowed against whistleblowers in the military; why?

Can you prove it was used as reprisal? Also vague posts about situations don't help anyone find answers.

To much missing information to be able to advice or form a valid response.
However n my experience its never a bad thing to get individuals medical help - physical or mental when needed. I would need to read the IG complaint as well need to talk to the individual asking for the psych eval If the individual is or has a mental health issue like bi-polar it needs to be addressed at some point in time by medical professionals. I'd rather error on the side of caution than to allow an individual to have a psychotic break. Its just not safe.

Sir, you would first need proof of the reprisal. If it was in fact a reprisal, then I would say it's wrong. If you're aware of this injustice, then why not report it to someone who could stop it? Why are you asking us for our opinions on something that you seem to be sure is wrong? It seems like this is you trying to get people flustered about something without us having any evidence to the veracity of the claim.

You have something in writing stating that he was referred because he submitted an IG complaint? Really? Otherwise it sounds like you're just connecting random dots...

From the stand point of the medical officer, my first question would be "what clinical symptoms lead you to this diagnosis, and what training allowed you to pick up these symptoms". As to the IG complaint, there is no where near enough information in your post to answer the question.
