One of the first things I noticed is that this is not in the United States:
1) The license plate of the pickup truck is not American. It looks like something you would find in the Middle East or Africa.
2) The Soldier is not wearing an American military uniform (among other red flags).

It turns out this supposedly happened in Nigeria. Something tells me that it's less than a reputable news site however.

This NCO"S response to this situation was very emotional if I was his commanding officer I would do everything in my power to get him out of trouble. You see when a NCO does his wife dirty she comes to the command master chief or the the commanding officer. What does this NCO have Hmmm the chaplain a lot of good that will do him. First off.....he didn't kill one or both of them, so that is good. He showed great restraint there. Forcing them into the open, and guilty of "Indecent exposure" is where he could run afoul of the Civil and UCMJ......but as his CO, or NCOIC, I think his punishment would be along the lines of Extra Military Instruction (EMI) writting an article about what civil and ucmj issues run hand in hand....

Ask him to explain what happened and his response. Would recommend (at the most) Letter of Counseling to be removed on PCS. Give him time of to clear quarters and re-settle, place his furniture in storage or ship to HOR. Take in his response and if appropriate, to privately congratulate him on his restraint.

Whether it was done in the US or any country in the world, I would commend the soldier on choosing a righteous approach to his situation. Many soldiers elect to kill, or beat the lights out of them. He chose to pull his weapon, as any law enforcement soldier, and check what was going on in his house, when he heard his wife moaning, in his bedroom... Well, he found crime, as adultery in the military is punishable! In 2005, as I was in Afghanistan, I found out that I was being a third wheel... and I opted for a divorce, non contested... it turns out that this woman was doing it, since 2003, when I was in Iraq!

I would take the service member out to lunch, assess the sm's emotional state, brainstorm how he or she might want to proceed forward, and ensure the service member has access to all the necessary resources he or she is going to need. Obviously, depending on emotional state and direction sm would like to proceed, I would make myself available to ensure I provide additional support, e.g., help with relocation, getting them to the bank to open up new accounts, etc. Then I would report to my commander of the situation and advise accordingly. Obviously, if no one was physically harmed, I'd recommend that sufficient action has been taken to prevent any administrative action and that the command should do everything within its power to ensure the welfare of the sm.

Working in his favor he did not shoot either one. As a SNCO I try and stay out of the troops personel affairs,and in this case I definately would. If the incident was off base I'd let the civies handle it and would advise the CC the same. Truth is I would probably foot the bail money if needed. I believe the guilty got off very easy.

I think he should have tried to avoid cameras, a C.O. would have to do something once the behavior is brought to light. Seeing that he could have done something far worse, and no one was hurt, and it is pretty damn funny,as his C.O. I would find the minimum charge and give him a suspended, minimal sentence. Since I had this happen to me, ex-wife and E-2 jarhead in my off base home, I'll tell you:
1. what I did, AND,
2. what I'd do if I was his LPO.

1. I told the young Marine that if I ever caught him in my house again, he'd be a dead man, and that he'd be better off not playing Jody. He couldn't tell me what Semper Fi translated to in English, so I educated him to the fact that at THAT point,I was more ALWAYS FAITHFUL, than he, and that his CO would hear about the incident. (CO wouldn't give up the ssn for his devil dog to be prosecuted by the UCMJ, Ship's legal didn't want to take the case. Said I should've done things to make it more than a he-said/she-said case. I asked, “like shooting then both through & through with a slug from a .45 while my kid is laying on the floor, screaming, in a shitty diaper? Would that be evidence enough, Sir?")

2. I'd tell a young sailor now (in the cell phone age) not to kill them, but photograph/video coitus, before hiring an excellent divorce lawyer. (I believe this advice would be in my “welcome aboard" speech to each new transfer into my command.)

As a former NCO, I would take care of my soldier- first and foremost. No one deserves this, but it does happen more and more these days. His restraint and maturity speak for themselves, and as long as there was not police involvement, then get him the proper assistance (counseling, divorce attorney etc.) to aid him moving forward.

I would do nothing to him because he did no wrong. In fact he did something right. He could have done many things to them both right on up to killing them but he didn't. The punishment fit the crime. In 85 I was in Korea, a good friend decided to surprise his wife mid tour. Walked into his home ran into his sister-in-law. Her response was she will definitely be surprised and walk out the door. As he walked into the bedroom he found another man sweating on his wife. The offending male was lucky the home was only two floors, he was then assisted (naked) out of the home (through the closed window). Police didn't charge him. Wife was lucky enough to be asked to leave. I think these two where lucky to have been walked out....

I was deployed and my ex-wife, did the same thing except the two dummies were going back and forth on email. He had his ships command email address. Me being in admin at the time, found my wife email open and I read every letter. The two of them played to be cousins. Never showed signs, I watched carefully. So I fwd all the letter to his CMC and XO. Needless to say he is no longer in the military. I also have full custody of my daughter, and the wife is pretty much living on the streets. Lesson: think before the actions. I would have done it differently. Its called cellphone with camera.

Back in early eighties an airman I will not name had a wife who was cheating on him. She was a TDY whore. While he was TDY she would go party! Well he shot himself over his cheating wife. She went out and partied some more. So ya what this guy did was spot on!

As his CO, I would've not done a thing to him. This is a private matter (no pun intended) and it does not seem to be an issue that will affect the unit. I was sent home on ER leave to secure my Son from my EX after School called Family Services on my Son's behalf.

EX didn't know I was contacted. Upon my arrival in USA, it was arranged for me to have a Police escort. It took all my strength and then some to restrain my natural human desire to respond with violence! I didn't, for it would of been the worse course possible for my Son!

She was caught red handed in the cookie jar with 3 Police officer present! Everything reported to me was there, minus the drugs. We (I & Police) believe the drugs they had from Mr. Wonderful were flushed as PD knocked on door.

She left that day (15 November 2008 @ 1515hrs) and we never saw her again and my Son and couldn't be happier! I was an E8 then so, it happens to all ranks, not just young Soldiers.

I gained sole custody of my Son within 30 days, returned to Iraq, completed the last 7 month's of my tour and then retired at the end of year in 2010.

My EX got nothing!
We got everything!
Most important!
My Son and I have each other and a very happy and fruitful life!

I caught an ex in the same "position" except the cold steel feeling of the shotgun ended everything. I just looked at them, he was a drug dealer, and escorted them outside. Still carrying the shot gun. This was military housing too. The MP were called, arrested the drug dealer for dealing on Federal property, she was escorted off the property and a no trespass order was handed to her. I don't know if she ever got clothing. Was my circus definitely not my monkeys. 2 days later my CO asked about it and he got a good laugh too.

Reading some of the other questions on the right side of the sight, I will respond to the General Lee comment. If we start to take down, get rid of or destroy our history, then we are destined to repeat it! Take the rebel flag for one, it has been taken down because it offended some, WELL, if people actually did their research, that flag was a battle flag , used by troops on the battleground. I always ask the offended people, can you name me one race of people who haven't at one time or another been enslaved by another race? If you get offended by the rebel flag, then you obviously need to take down every flag from every nation! America did not invent slavery, yes we have a dark chapter in our countries short history, but we also lost over a half a million men to end slavery! Slavery is still going on in many countries still to this day! The rebel flag also meant that you were not happy with the government and overreaching authority figures. Our country is getting to the point where anyone that gets offended tries to erase the offender or the offense and once again if you forget your history then you are doomed to repeat it! Where is the media outcry about the Black Panthers flying their flag or colors? Freedom comes in many different ways, that is why America has thrived and prospered faster than any nation before it! Now there are calls in some communities, to take down our national flag, because some say it represents a country built on slavery! Well, that is just utter BULLSH-----*(^%P&@$^^---T. As a Retired Officer, I'd have a long talk with him. I could think of many things he did wrong - parading his wife and her lover in public bare ass nekkid (naked means you have have no clothes on, nekkid means the same thing but in addition you're doing something you shouldn't), creating a scene, etc. I would verbally admonish him - and that would be the end of that portion of the story. I'd then go over the portion of what headed correctly. He handled a potentially explosive domestic in a calm manner, with no one getting injured. I'd be honored to have him as a member of my division and/or department.

Why would his NCO or commander have ANY jurisdiction over this unless it happened on federal property ie on-base housing? Off base, this is a civil matter, so the police and local courts have jurisdiction. What I would do as his NCO would be to offer him support in finding him legal representation from the base judge advocate for a firearm assault charge at the state level, and brief the CO through the chain of command regarding his possible absences. Some military folks think that the military has power over a member's life in areas where it doesn't. What should you do as an NCO or CO? Offer support. On base, the MP's, installation commander, military judge advocate, and federal appeals court has jurisdiction. As his NCO or CO, same thing. Prepare to offer support and find out what military and federal laws apply in the situation regarding the responsibility of his chain of command regarding any possible firearm assault charge. If I were the judge, I'd dismiss his firearm charge and help him nullify his marriage. Then I'd personally pay for his plane ticket to Europe if he could get leave so he can go be instantly single and getting laid. If he decides to send videos of his exploits to his new ex-wife I would cheer.

Well I've seen a lot worse reactions in over 40 years of full time Law Enforcement. Some pretty serious that had involved guns, knives or and bad beatings. In response never show up on the scene with only one Police Officer or Military Policeman. If in a one man unit, we met another unit short of the scene and arrived together. These may well have been one of the most dangerous calls to respond to.
