The fact remains that we are engaged in a conflict with an enemy that does not play by the same rules we hold ourselves to. Any enemies we capture whether they be overseas or your run of the mill home grown terrorist should be detained until we have no further use from them. Should we try to garner intelligence, of course because that's what the enemy is doing to ours. No we can't keep them forever, but we should keep them until we have no further use from them. If we need collateral for a prisoner swap, then at least we have something in our back pocket. But we can't be doing a 5 for 1 prisoner swap like we did for Bergdahl because that's the kind of thing that puts a price on our heads. 1 for 1 swaps is the most we should ever do in any negotiations. If there comes a time when we are no longer engaged with the enemy, then we can open up terms to release any detainees providing that they are not a continued danger to the people of this Country. For example, your average footsoldier might not be a future threat, but the bomb maker responsible for the deaths of dozens if not hundreds might be too dangerous to release.
