VA disability rating is based on potential disabilities. I know of one man who has a 130% disability rating and he is still working because his disabilities do not preclude his line of work. <br />In my case I have been rated so far at only 80% disability but because of medications and their effects I am unable to safely drive long distances and because of other disabilities not able to negotiate stairs very easily or safely. Even though I had a 10% disability, I was never asked about it. It would seem if you were otherwise qualified and they actually said that was a reason, there is a fair chance there could be a ADA claim made. Short answer is no it would not, at least on the surface. But, there isn't age discrimination either. I have met a few that had 100% and still worked. I on the other hand am not that lucky.
