The Firearms Owners Protection Act is clear on its prohibition against ANY federal database of guns or gun owners.

"No such rule or regulation prescribed [by the Attorney General] after the date of the enactment of the Firearms Owners Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or disposition be established."

Hawaii’s move is in direct contradiction of FOPA’s mandate.
Oh and NO SUCH LAW in Hawaii exists, it is a proposal at this point..not a law. Thus your title is not accurate

If such a law does exist, and there isn't a Federal law invalidating that law, I wouldn't like it... however I really don't give a crap if my name is in another Federal database at this point.

So I ask gun control advocates, what exactly does this do to stop mad men or women from perpetrating heinous crimes upon innocent individuals. And what crimes are in the bill that will automatically notify police if an island resident is arrested anywhere else in the country. What happened to due process? An arrest does not constitute a conviction. Sounds like an invasion of civil liberties and I'm sure there will be many appeals. Could end up costing the tax payers of Hawaii a bundle in legal fees.

I'll postulate for discussion there continues to be a "database". It isn't called that because all that's maintained are "entries", i.e. the weapon, owner, etc. whenever you fill out the Federal form for the background check. So the "entries" are on a storage medium. Every day more are added and backed up. How do you think they trace stuff used in crimes? I suspect "analytical tool" includes features of tabulation, search, etc. which is the software that would get used to query "entries". So long as the two are not connected (yeah right), they can say they don't have a database. I'd figure the same would be true for phone metadata. There's always "we don't do that" but what gets missed is the "so what do you really do?" An easy way to bypass the FOPA is offshore record keeping by a third party that you'd never find the contract that links it to the Government. Why have a contract when you use Grey Money? Add to that all sorts of non firearms related data about you, then there is an excuse to say "we're not maintaining for the purpose of firearms use". They won't say "we're maintaining a lot of data about you for which a portion is firearms stuff."

So am I a conspiracy theory type? Not really. I was just channeling my "OJ If I Did It mode" while I decide what wine to cork for tonight. I make this point to say for those who declare the provisions of FOPA are absolutely clear, think again. Although it sounds tight, there's plenty of space to drive a Mac Truck through. There always is and that's what lawyers do. Even if it's violated, you'd have to see what the provisions of enforcement are in the Act. If it's a Nothing Burger, then it's begging to be ignored. And if you sued with class action, etc., the Judge would say "What are the damages?" Well, nothing really.... yet. OK, so I'll issue a decree. OK, that just says follow the law. That could get ignored as well. So the penalty for getting caught is a bad PR day in the news cycle at a minimum, always on Friday afternoon after Wall Street closes. Tough seeing what else may happen.

Not in favor of this. When you purchase a firearm you must fill out a ATFE Form 4473. That is a Federal data base and should be enough.
