In addition, 4 soldiers from my platoon were added. 3 latinos + myself for a total of 4 latinos out of 5 in the detail. This was shortened to 2 latinos + the other soldier.<br /><br />3 weeks ago, and with 5 days advance notice, I was made the NCOIC for yet another detail, baggage detail. Want to know how many latinos were originally sent to this detail from my platoon once again? 4 latinos.<br />How many soldiers were originally sent in total? 4 soldiers.<br /><br />Now, we&#39;ve had a Soldier on Extra Duty for Alcohol related offenses and instead of sending him to Staff Duty for the Extra Duty program, our 1SG wants us to take responsibility, but of course it is only us E-5 doing the extra duty watch with this soldier.<br />Someone has to watch him in weekend of course...guess who has gotten tapped several weekends? This guy.<br />At one point, during block leave, I jokingly told my wife I was going to ask for a weekend in advance because I knew they would tap me again.<br /><br />And sure enough, on New Year&#39;s eve I get a message telling me that I have extra duty watch on Sunday. When I reminded them I was on leave they threw a fit.<br /><br />I guess the operating point is that I knew I was going to tapped for weekend extra duty. As in &quot;I know i&#39;m being singled out&quot;<br /><br />As of an hour ago, I was sent another message informing me that I have to do the extra duty watch tomorrow, which for my unit, is a DONSA.<br /><br />So once again, I am being assigned to a &quot;sh|t detail&quot; that more and more looks like a punishment.<br /><br />For what reason I don&#39;t know.<br /><br />I am the Master Driver for my Company and I just passed an unscheduled Program Inspection with a 91% first time GO. Inspector was impressed as it was the highest score by far he had seen for an unscheduled inspection.<br />I have nothing but stellar reviews from every Battalion/Brigade NCO/Officer I&#39;ve worked with since arriving to this unit...but for some reason that doesn&#39;t translate to my own unit.<br /><br />I keep getting shoved into the duties no one wants to get, and not only that, a majority of latino named personnel is sent to those details as well.<br /><br />So with all this said, I&#39;m not certain if this can be retaliation (against what...I don&#39;t know), or flat out discrimination? (I am 46 and latino?) or I am being singled out simply because my PSG doesn&#39;t like me?<br /><br />My wife is having heart surgery this Tuesday at 0500, and tomorrow Monday we had plans to spend the day doing activities to relax her for her surgery, last minute plans/what ifs, etc.<br />Of course my unit ran out of &quot;Fs&quot; to give as they stuck me with this extra duty watch and so far no one is replying to my concerns.<br /><br />UPDATE:<br /><br />My wife surgery is today, she should be released either tomorrow or Thursday. The issues/problems with your unit may or may not be related to discrimination, but it is difficult to tell from a distance without having better demographics of your specific unit. Before I address the EO/Race Relations aspect of the issues; I would like to address the most important item - Family. Since your spouse is having heart surgery, and that it is soon, I would try to get that addressed first. I would first go to the next NCO in the support chain above the NCO highest in the chain that you have personally told and verify that they are aware of the situation with your spouse, then proceed from there.<br /><br />Next, to address the race/ethnic issues - think about the ethnic ratios in your unit both lower enlisted and junior NCO's. What caliber of troops are the Hispanic soldiers assigned to the details that you have spoken about? Are they knuckleheads or are they good troops? Though it is not FAIR, are you one of a few Hispanic/Latino NCO's in your unit? (though that may not be fair - you could be a Filipino for all that I know.)<br /><br />The Staff Duty and CQ - from my perspective, stuff happens.<br /><br />A couple of side notes, since your were in an aviation unit with the 10th Mountain;<br />Did you or do you know Mr Sean Wojasinski - an Apache pilot?<br />Did you or do you know LTC Ricky Ortiz - was an aviation Bn CO? Ask to see th DA6. If you cannot get a satisfactory explanation, let them know you want to exercise the 1SGs open door policy. First ask your supervisor to see the DA 6 for CQ duty. Next ask your supervisor why is it you are the only E5 getting the majority of extra duty watch? Also, if you have engaged leadership then with your wife having heart surgery hopefully they will take care of you by letting you be with your spouse. Is there someone in your chain whose judgement you trust? That should be your first start. Explain the situation and give them enough reasonable time to investigate / resolve the issue.<br />2. Make sure you document everything, even if it's just an MFR, and don't buck the chain more than necessary.<br />3. EO is a great program, but I don't believe it was instituted to be a casual step, but more of a last resort, and puts alot of processes in play...you can't "un-go" to EO. To anybody that has anything to say about me being illegally retained in service: 1. There was no stop-loss order, they were actually refusing to issue me another ID card because I did not have orders until they got a phone call from a high ranking officer in my unit mainly responsible for illegally retaining me. 2. I was already four months past my contract before we even deployed. 3. In order for stop-loss to even be enacted it has to be an entire division movement which we were deploying in separate brigades some of them even 6 months apart. I tried to fight all of what was going on and the sad truth of any of it is that there is actually nothing you can do about almost all of it, all of the places that you are supposed to be able to go, like IG for example, all just turn their heads and act like if they don't see it then it isn't happening. I say visit both, and see what the best option is for your situation. Whatever you do, don't do anything drastic. I did the latter, and the consequences will be with me for life. Keep cool, and take the matter as high as you can until you get results. Worse case scenario; they will transfer you to another unit or section. Now keep in mind, there is no telling if your gaining unit is going to be any better than the one you transferred out of. You could also play their game and let them know that you also require the unit safety officer to be present and oversee things to ensure OSHA compliance and use of any product that has MSDS info... Lol. <br /><br />When it comes to your wife (and well wishes to her for speedy recovery), in my opinion it's considered best practices to give guys time to spend with family members for events such as this. So I'm in your camp there, but I'm the world of black and white, is this required? (Something to look into because I don't have that Intel off the top of my head)<br /><br />Circling back to the Latino thing, tread lightly there... Sometimes units are comprised of more than once ethnicity than another (just an observation from my experience) but when you're in charge of selecting personnel for a detail or are vying for a boondoggle tasking do you want everything derailed because you're missing 1x Asian (&lt;--- random example for illustrative purposes) to comply with EEOC regs? Generally, nobody gives a crap about your color, religion, ethnicity or what color your hair is. Stay in regulation, talk when its appropriate and don't talk when its not. Its no different in the civilian world, maybe less severe but still no different. If you are being picked on or singled out, 99.9% of the time you are demanding to be singled out. (not saying you did, just a good habit to develop).<br /><br />2) Keep book (already mentioned and you are doing that.) - make sure your ducks are in order.<br /><br />3) Approach Chain of Command as high as you can go. When I was in no one would talk to you until you had tried the Chain.<br /><br />4) If the Chain doesn't help - go EO, IG, JAG, even Congressman (nuke option and last resort).<br /><br />5) Be prepared to accept the consequences of your course of action. Remember, as I've said before, the Army Private's Law of Gravity - Crap rolls downhill and we are on the bottom. You may win the battle and lose the war if you are not careful; no one is 100% correct 100% of the time and if you have a bullseye on your forehead...<br /><br />I am not saying you have to sit there and take what appears to be some kind of singling out either racial, or your PSG doesn't like your mouthwash, but what I am saying is when you go against a giant, expect him to fight back. I have found that that some units may single someone out and theirs nothing that can be done. Your job? Are people starting to shy away from you? Do you suspect people are talking about you behind your back? Even folks not connected to the military or your unit? Are you a Christian? Is their seemingly a strong Pagan, Wiccan group in your unit? Do they really get into Halloween? Do they try and call Christmas the Solestes? Have they talked about canceling the Christmas party? Has ominous enochine symbols appeard on windows?<br />This all sounds bizar I know and realize that, however if your being singled out then there is a bigger picture. I would suggest opening your eyes wide and looking at everything all around you. Try going to Church for prayer, ask the Pagan or Wiccan Military Chaplains to pray for you. What ominous comments have been made to you? Anyone made suggestive thoughts or comments to you? <br />I would quickly analyze your situation and look at health fitness and the obvious not to say anything to anyone about anything that is not work related. I would hit the gym more often focus on physical fitness, focus on your current job and drive your focus directly to your work and your unit needs. <br />If not you could end up in a psyc ward. Being discharged with some kind of personal behavior problem and be out on the street wondering what to do next. The DA-6 review is the best initial route to follow. Also if you are the" Go to Guy" he may not realize that you are being disproportionately tasked with additional duties. This is where the 1SG needs to look at development of the unit's NCOs, instead of allowing other NCO to stagnate while burning out the good NCOs. Could there be some bias in his actions? I can't say what's in someone's heart or mind , I can only see their actions and reviewing the DA-6 and discussing your concerns with the 1SG and the CO if need be should lead to your concerns being addressed. Should these efforts fail you can see your CSM or BN CO and or the IG. Good luck and don't let negative experiences make you become a negative NCO your Joes need you. A little known fact is that most Post command units (Corps/Div) establish command policies to include "Standard duty day" which also explicitly details the requirements for working outside that "standard duty day" (O-6 approval, etc)---obviously being on deployment/war footing can change that but it is somewhere to start. Learn &amp; use all your command policies--which includes the policy for requesting leave. An informed NCO is a valuable &amp; strong NCO. 2. The DA 6 is for CQ/SDNCO and it may be your 1SG or the Training NCO filling it out---find out and review it. , they don't just post it for the public. Last minute changes are notoriously "forgotten" and someones loses credit for duty all the time. 3. I encourage using the NCO Channel unless you already feel it has become a hostile situation---if it has, then there is the Command and finally IG (EEO you really need more blatant racism, IMHO) 4. Keep notes, see if a DA6 is being run and copies kept. TALK to your first line supervisor. Use your chain of command. Give them a chance to look at and correct the problem if there is one. Is the unit short of NCO's? Is there NCO's that cannot be counted on? If you feel your chain of command is not being helpful, then go to the CSM. But you MUST have proof. When soldiers came to me, I had to check things out. Out of all I looked into, 1 was justified. The others were just ones complaining. I am not saying that is what you are doing. I dont have enough information. Keep notes, text, counseling forms, copies of the DA6, the dates you had duty, who you had duty with, the circumstances with which you had duty. Maybe the other NCOs who could have had duty, but if it goes that far, the chain of command will have to explain why the others were not picked. Be prepared to move units. I have seen that happen. Sounds like it's not being managed at all. There are also supposed to be 2 separate DA 6s for staff duty and cq. If however the 1SG leaves it up to the platoons (something that happens frighteneningly often. Why did you want to be in charge again 1SG?) You've said you pulled both cq and SDNCO, that right there is outright wrong. Unless, and this is a big one really, there aren't enough NCOs. One thing you failed to mention young SGT, and it's really kind of important here, how many ncos are there in the available pool? If they do not have one, again, you can show them how to prepare and manage one! however, I think that the 1SG, as a fine NCO, will already have knowledge of this. Another thing to consider is that maybe your Platoon SGT drew not know about this and is just going with his strongest suit? <br /><br />The most important thing in life is your family. I was able to make it home with my family for 24 of my 31 years. They will be the ones that will be around after your DD214. But I do agree with the majority here to include a couple 1SG's. They are correct. A DA 6 should be readily posted in your company area and available for you to make a copy of so you can have for your records. When used correctly, the DA 6 rules out those complaining of to much duty or duty on a weekend. It is fair and equal across the board. As a Senior Paralegal NCO, I would be concerned that your 1SG has taken it upon himself to have those on extra duty be monitored at Company level. Most BN CSM's specifically state in his/her policy's that those on extra duty will report to him or his Battalion Staff Duty at 1800 hrs. That's time for them to be released at about 1700 for dinner chow then report for their extra duty. But for some reason, your 1SG tags You and a few other NCO's. My question to you would be this, how many Enlisted Soldiers and NCO's do you have in your unit? And of all those NCO's how many DONT perform CQ or BN staff duties? As far as your assumption of Race being a possible factor, of everyone assigned in your unit, what is the ethnic background? In my 20 years and many units I have been assigned too, each unit had a predominate ethnic background and it was not always white. You cannot assume that the reason for all of this is because of your race. If that truly is the case then as an NCO you should know the EO process and follow that process accordingly. But remember, YOU have to handle things tactfully and respectfully at the lowest level first. When that fails or there is "retribution" then you respectfully move up the chain of command. It may get worse before it gets better but hopefully everything works out and not just for you but for your unit as well as this could be a learning situation for all involved. Performance fell along with morale needless to say and being the ranking E5 at the time my attempts at informal discussions with him resulted in just lectures and that "he was in charge." Since our chain of command was several hours away and on the rare occasion that duty requirements meant someone had to visit the head shed guess who always went. Not having that much time left there and seeing the hand writing on the wall I kept copious notes with dates, times and other information while going into CYA mode and trying to keep others from doing something stupid. The day I left Korea I made a trip to the 1st shirts office prior to catching the bird back stateside and handed him my notebook. Several years later I learned that he did not complete his tour there and also reverted to his former rank. The moral of the story, keep good notes with specifics and when all else fails... It might be overlooked if you were drafted into military service but you made a commitment to voluntarily serve your country so from this standpoint, the many "suck it up" comments are valid. However, if you have a valid concern that you're being discriminated against, you'll need to be able to prove it. It may seem like you're being discriminated against but it appears that you're the "new guy" from the info in your post. We all go through this with a new assignment/unit and it fades with time as we build relationships with our new peers and supervisors. The problem also sounds like the unit leadership hasn't placed enough emphasis on sharing the "crap details" with others or it could be that they want to see how you handle yourself under this rite of passage. All assignments to detail, except authorized special duty details, or other exceptions (see para 7 c ), will be made in accordance with applicable DA Forms 6. <br /><br />There are caveats which allow units a certain amount of discretions, for example: When details from units will be formed by taking units in turn according to one DA Form 6 , the DA Form 6 may be used by listing unit designations in the place of individual names. Commanders may devise their own method of assigning details to units. Field Manual (FM) 22-6, appendix B provides examples of some methods that may be employed. However, it is emphasized that commanders may use whatever system best meets their needs as long as equity is maintained. <br /><br />I enlisted in 1973, and in the following 15 years (plus or minus) there was a lot of discrimination and the use of details as an enforcement tool. The final words of the quote above are important, "... as long as equity is maintained." This explains why units are not following the letter of the regulation, without getting in a lot of trouble. If you can PROVE equity was maintained, you can get away with it, but if someone shows up with proof they pulled a detail 6 times, and SPC Snuffy hasn't done it even once, your ass is grass, and the senior commander will mow it.<br /><br />Do units pick a "hey you" detail without a DA-6? Yep. Can they get in trouble for it? Damn straight. Have CDRs and 1SGs been relieved for failure to maintain a duty roster? Yes, I personally know of two cases. Are you going to win any points with your unit for playing barracks lawyer? Not in any decent unit I've ever been associated with. <br /><br />Take a close look at paragraph (3) above. Is your unit following that to the letter? (Probably not.) What should you do, raise a stink about it? Maybe it would be best to just use the open door and gently suggest that the unit's command staff is leaving itself open to attack by a barracks lawyer - not that you personally have a beef, but you just want to see the unit continue to do good things. And if Battalion is maintaining the rosters in the name of efficiency, maybe the same answer. Unit commanders don't get a pass for saying, "Command made me do it that way." (They can't prove that they left a voicemail or that your phone rang; phone records will just show that a call was placed to your phone) What's to say that you had reception or even took your phone with you? My rule of thumb is that my personal cell phone is for my personal convenience; not my command's electronic leash.<br /><br />Might want to schedule some SGT's Time Training and take some of the boys up to the IG Office (especially if you have some E-4(P's) that may be up for the Promo Board; arrange for a presentation and some Q&amp;A) Slip the Company Clerk a pack of smokes, can of dip, energy drink or whatever he's into and ask to get a copy of the last few months of duty rosters (make up something like it''s a training aid and you want to quiz some of the soldiers on how to deconflict scheduling).<br /><br />Head to IG to "Get some clarification" on "an issue that may or may not exist with a soldier under you"...while you're there, get some clarification on your own issue. Collect supporting documentation clandestinely so command doesn't try to cover up or have "...that fucking Private, delete/lose it" conveniently. Shit, if you can get copies of the CQ, Staff Duty Logs, even better!!<br /><br />Start making nice with your branch manager back at Army HQ and have him/her search out some different vacancies either on-post with other units. Take a few of your NCOER's and drop them off with other units and talk with those S-1's &amp; the CSM's.<br /><br />When I switched over to SF (support), I delivered pizzas for Dominoes with a Sr. Comms SGT Team Guy; he and I met for lunch over at the compound and he introduced me to the MI Det folks (now I may or may not have stopped by my off-duty, civilian employer and procured some rations...building rapport is key). We worked out a plan and phone calls were made behind the scenes. Once I had a 'New Home' on paper, I began my reenlistment process. Funny thing was that my NCOIC failed Airborne School and was not accepted to go across the fence to the dark side and failed me on my PT test (in the 2-mile run of all events). A few days later I challenged the test and re-took it; I also had a CAV Scout Plt Sgt do the run alongside me (he was pushing for me to go to SFAS) and he timed our run on his own, separate from the 'official time'. I thought I was good to go to reenlist when suddenly my APFT went missing. A couple of phone calls later (and the Group guys getting irritated at their time getting wasted) my team friend called me over for lunch, called the E-7 that I ran with to verify the scores that I received verbally. My team friend and I 'conducted another APFT', I will not confirm or deny if it was a written AFPT or not but the next day, I was able to come into my unit with an official APFT score sheet, signed by E-6 or above. I actually had two original forms (one went to the reenlistment NCO first) then the other to the CDR/1SG.<br /><br />There's the right way to accomplish your objective, the wrong way and then there's the back way. Since the three different scout sections deployed at different times and location with differing periods deployed - Different ethic groups sometimes pulled the bulk of duties when they were in Home Station. It sometimes &#39;seemed&#39; that one group (Latinos for Hispanic Countries, Blacks for Caribbean, Whites for areas where Gauchos/European descent) were being targeted if an outsider observed the duties and details.
