It is in direct violation of AR 670-1 that she does not have a firearm on her person concealed or not. The only soldiers allowed to have a firearm on their person are MP's that are on shift. She is violating federal law. Her leadership has failed her by not instiling discipline in her. My Team Leaders and Squad Leaders throughout my service instilled discipline into their soldiers, I never would of even thought to do something like this while in uniform or not. Army is getting soft, but then again had other mos's enforce the standards as much as the Infantry did, we would not even have this problem with Jr. Enlisted Soldiers, and younger NCO's not in the Infantry. Gone are the days of parents spanking children in public for misbehaving. Now if a parent wants to discipline their child it is more of a negotiation. Instances like this picture are evidence of this. A properly disciplined individual would never act this way. Society has become entitled and only worries about things that will benefit them, likes on facebook, followers on twitter etc.. Until society addresses this issue, or the military truly becomes more selective, we are going to continue to have stupid problems that we shouldn't have to begin with.<br /><br />Finally, if you want to be a gangster, thug, whatever....there is no room for you in today's military go back on the block and leave this profession to the grown ups. This is happening all across the military, not just the Army. Young soldiers are accustomed to utilizing social media as a form of expression and tool for connecting with their peers. Everything situation is judged by outsiders who perceive it. Im sure she is young, in basic/AIT or just got out, and did not think twice about it; However, that is not how everyone else will see it. I've never heard of someone getting a promotion over a Facebook post. Open any newspaper and you will see the damning effect that Facebook and social media has on careers and out lives. For the record I have a concealed carry permit.<br /><br />The question should not be about a permit but when this Soldier will be charged under the MCM.<br /><br />We do not know the location of the incident on or off post but we do know the Soldier was in uniform and the statement reads "always keep one on me". Which implies while on base and on duty.<br /><br />A weapon is not authorized on a military installation unless it is in the performance of official duties, located in a housing area, being transported to the housing area or away from the housing area in accordance with post regulations. Usually with either the weapon or ammo being stored separately in a locked container.<br /><br />A concealed weapon as alleged above is a violation of federal law. Concealed permits are only good for individuals on state/county control land and the reciprocal agreements that states has will other states. It does not apply to federal lands, buildings, or property. For example it is illegal to carry a weapon into an IRS building, Federal Court House, or any jurisdiction under federal control. This issue was rapidly elevated to public view after 9/11 when 100% searches were implemented on military bases and concealed weapons to include loaded long guns were found on bases across the states being brought to work everyday by Soldiers.<br /><br />The MCM states:<br />112. Article 134—(Weapon: concealed, carrying)<br />a. Text of statute. See paragraph 60.<br />b. Elements.<br />( 1 ) That the accused carried a certain weapon concealed on or about the accused’s person;<br />(2) That the carrying was unlawful;<br />(3) That the weapon was a dangerous weapon; and (4) That, under the circumstances, the conduct of the accused was to the prejudice of good order and discipline in the armed forces or was of a nature to bring discredit upon the armed forces.<br />c. Explanation.<br />(1) Concealed weapon. A weapon is concealed when it is carried by a person and intentionally covered or kept from sight.<br />(2) Dangerous weapon. For purposes of this paragraph, a weapon is dangerous if it was specifically designed for the purpose of doing grievous bodily harm, or it was used or intended to be used by the accused to do grievous bodily harm.<br />( 3 ) On or about "On or about" means the weapon was carried on the accused’s person or was within the immediate reach of the accused.<br />d. Lesser included offense. Article 80—attempts<br />e . Maximum punishment. Bad Conduct Discharge , forfeiture of all pay and allowances, and confinement for 1 year.<br /><br />Each installation has a supplement to AR 190-11. Here is one from Fort Benning.<br /><br />Supplement to AR 190-11 2-1e. The carrying of a concealed weapon on the installation is prohibited regardless of whether a state or county permit has been obtained. For the purpose of this regulation, a concealed weapon is any instrument used or designed for the purpose of inflicting grievous bodily harm that is carried on a person in such a way as to be hidden from ordinary view. Folded knives with blades shorter than 3 inches are excluded from this definition.<br /><br />l. Personnel authorized access to the installation may temporalrily secure, or transport privately owned firearms or other weapons to functions or activities involving those weapons (such as hunting, sports shooting, or other legitimate reasons) subject to the provisions of this regulation.<br /><br />2-2i. Persons are required to produce, upon request, the firearms registration document to any Military Police Officer, Department of the Army Police Officer, Conservation Law Enforcement Officer, or Department of the Army Security Guard. Persons without the regis-tration document will not be authorized to bring the firearm onto the installation and if found to be on the installation in possession of an unregistered firearm will be processed as follows:<br />(1) Military personnel found on the installation, in possession of an unregistered firearm, in violation of this regulation, will be apprehended, processed, and titled under Article 92, UCMJ and released to their Commander or First Sergeant.<br /><br />There is nothing I can find that specifically states a Soldier cannot carry a weapon for that matter a concealed weapon in uniform. However there is a lot of information that details the procedures for Soldiers in the performance of their official duties must meet in order to carry openly or concealed in or out of uniform while performing official duties. There is also significant information on how, when, where, and under what conditions a Soldier is allowed to own, store, and transport and gun on post.<br /><br />My interpretation based on the absence of information on the issue being addressed and the information contained in the regulations and supplements appear to indicate Soldiers are not authorized to carry in uniform. To do so subjects the Soldier to violation of Military and Federal law.<br /><br /><br />Am I against concealed carry? Absolutely Not? Do I believe Soldiers should be allowed to carry a weapon at work concealed? Under the current laws absolutely no. <br /><br />This Soldier should be punished to some degree based on the facts of the case using the social media post as evidence "relatively new procedure" with the military justice system. Counseling to Courts-Martial (based on the facts of the issue and not the emotions of the issue) <br />If leaders know of this and have done nothing that seriously concerns me. This is about doing the right thing even when no one is watching and upholding the law. We have a responsibility and duty as Leaders. Sometimes we even have to do things that we do not necessary agree with. Examples I saw during my career were: folks being upset with don't ask don't tell, presidents they did not care for, military operations they felt were not moral. etc. We have an obligation to uphold the law and do our duty even if it cuts against our grain. If we don't think it is right we have an obligation to enforce and then attempt to change the law or issue we disagree with. I fully understand sometimes these issues become overwhelming for people and finding right and wrong can be a tough ordeal based on the facts and emotions of an issue.<br /><br />Other side of the coin <br />We are Soldiers charged with the responsibility to keep peace throughout the world and face our enemies both foreign and domestic. If we are provided that Awesome duty and responsibility are we only allowed to carry a gun on the battlefield in the performance of military duties? So does that mean we are not stable enough or responsible enough to hold a loaded weapon on our own? WOW! Working in joint operations I heard Sergeant Major from another Country say "You Americans amaze me! You are all about Risk Avoidance not risk mitigation! Hell your Soldiers don't even carry loaded weapons on a daily basis"! Is your government that afraid of its Armed Forces!
