Based on what I've read about his case, execution is not warranted. You'd expect it to be a slam dunk case for a death penalty to be implemented. I think there are too many unanswered questions to call it a slam dunk case.

I think Mr. Trump doesn't believe in Due Process based on his comments thus far.

Regardless of our "gut" and what "we think" everyone has the Right to Due Process, and both WE and the PRESIDENT are sworn to the Constitution of the United States of America.

We've already lost one President because he thought the rules didn't apply to him. You don't get to go with your gut on matters of Justice. You go with the Constitution and the Justice System(s) (including the UCMJ).

On this case, Mr. Trump is wrong.

Sgt. Bergdahl may deserve to executed for his transgressions. But he deserves Due Process FIRST. Mr. Trump is bypassing that. And the Senior member of the Executive Branch. The COMMANDER IN CHIEF, CANNOT, and SHOULD NOT, ever do that.

He's WRONG. Ethically WRONG. Morally WRONG. CONSTITUTIONALLY WRONG.

Trump says what attracts attention only, and leaving your post applies to being on guard duty. Bergdahl walked away from his fire base, which I find interesting that no one saw him leave; I am grateful that the Taliban did not know about that path. There is more to this.

To Mr. Trump's thoughts, I could give a flying rat's-back less: He holds no credibility in military issues. In reviewing Bergdahl's case, I think we are looking at the first layer of a very ugly onion. However, an execution would only serve to elevate an already unfortunate funeral pyre.

IF Bergdahl is proven guilty in a court martial then yes, as I believe the crime he is ACCUSED of is punishable by death under the UCMJ.

I use very specific language because while I am entitled to my opinion (as we all are), and my opinion is that he is guilty, that is not for me to decide since I'm not a judge or member of the jury.

Bergdahl has some explaining to do. I do not condone his behavior nor do I believe he should be executed. He should not be allowed to continue any service or receive any compensation. The fact is he left his post before properly relieved as others have expressed. If he wanted to report issues in his unit the chain of command and IG is at his disposal. That being said I know people who paid the ultimate sacrifice to look for this individual and he must atone for his behavior or lack of. In regards to Mr. Trump all people are entitled to their freedom of speech as we fight for all of them.

Since Trump is not in the chain of command or involved in the investigation he can render any opinion he likes. It is just that, an opinion. Bergdahl is scum of the highest order. Trump is connecting with the visceral dislike of cowards/deserters/traitors to the country.

The one thing that seems to be getting avoided here is due process. There is a move afoot to try to get Bergdahl off so Obama will not be embarrassed for releasing 5 Taliban leaders for him. There are families of people that died looking for this asshole that deserve some closure too.

The delay in getting this to trial tells you all you need to know. There is no more evidence to be found this is delay for political purposes.

When Western Journalism asked their readers if Bowe Bergdahl should be court-martialed in August 2014, my response was: "Yes, Bowe Bergdahl should be court-martialed. He had a commitment to the United States Army, his Unit, and the people of Afghanistan*. He wasn't "ashamed of his country", or a conscientious objector when he signed his name on his Enlistment papers, only when it became convenient, and as an opportunist, he looked for a time to walk away. Because of his VOLUNTARY ACTIONS, he was NEVER declared a Prisoner of War (POW), and he doesn't deserve the honor and respect of that title. He was, is, and always will be a coward, and the 'wee wiggles' from his daddy that streamed down [Bowe's] mama's legs, were far more honorable than Bowe will ever be."
Now you (SGM Steve Wettstein) report that [Donald] Trump says Bowe should be executed for what he did, and you ask RP the same question.
Regardless of what Trump says, I say "Yes!"
I believe that Bowe is guilty of Desertion, which isn't defined as *leaving your post only applies if it's 'guard duty'* as someone earlier stated. 'Leaving your post' is leaving the point of assignment where one's primary duty/duties are expected to be performed, without the proper authorization and relief.
He's also guilty of being a traitor, and should be charged and convicted of complicity with the enemy based on his intent and accomplishment of "giving intelligence to the enemy, in violation of the laws of war". Bowe intended to make himself a valuable tool to the Taliban in Afghanistan, and offered to provide the members with current intelligence regarding troops strength and locations -- his unit was actually preparing to depart their forward operating base (FOB) the day that Bowe sneaked out of his quarters/tent, and crossed the wire that separated the U.S. Army from the Afghan community -- as well as teach them about the unit maneuvers and self-defense measures his fellow soldiers would engage in.
Due to his disappearance, his unit could not depart as planned, and there were several weeks of searching conducted by his unit members and the U.S. Army. Weeks of searching around the clock, in scorching desert sand and blistering temperatures; searching that would've been completely unnecessary if Bowe had remained with his unit.
It's been reported that there were several deaths (5 or 6 I think) that were attributed to the search and attempted rescue of Bowe while he was in the Taliban's custody in Afghanistan and Pakistan; I think it was '60 Minutes' who did an expose with soldiers from Bowe's unit regarding those failed operations and subsequent deaths. Knowing that the military (as a whole) long-ago adopted the custom of 'no man left behind', I'm far more inclined to believe the reports of soldiers who were there, than the DoD.
We can believe from Bowe's superiors that he was mentally unstable, and if he did indeed serve with the U.S. Coast Guard, and was discharged due to mental illness, the Army should NOT have accepted him as a recruit. If those allegations can be substantiated, I would encourage the families of the soldiers who reportedly died looking for Bowe to sue the U.S. Army.
A little more than the simple answer you were probably looking for, but it's my opinion, and explanation thereof.

SGM, I'm torn on this. On one side, I feel he should be put down like a rabid dog, being six other troops died looking for him. An eye for an eye. On the other side, it's more complex being that we swore never to leave a fallen comrade. In that, we recognize that we are willing to put our lives on the line to save another. Liking this person isn't a qualifier. So those six troopers didn't die in vain, they died doing what they were supposed to do. What any of us would also do.
I'm not really paying Trump any mind. His mouth makes debts he knows his a** CAN cash, so he doesn't worry about backlash or lawsuits. Not to mention He should change his middle name to Deferred. Not like he ever served or even tried to. If I need advice from Trump it's be strictly on business. He's the SME on that.

My personal belief is that execution is not warranted in this case. A very long prison sentence is more appropriate. Executions for desertion were meant dissuade military members from deserting, which was a major issue in times past. That is not the case now, as it is infinitely more dangerous to be away from your unit than to be with it under the conditions our troops now find themselves in. I doubt we will ever see executions for desertion again.

The Misbehavior Before the Enemy charge is interesting and has not been used in a very long time. If a death penalty is adjudged, it will be for that.

I think he should receive a fair trial, I think all mitigating evidence should be presented, to include the death and injury of those that were sent to search for him.
And then then after the trial, if he is found guilty an appropriate punishment should be decided upon by the jury...
Hanging is fine
Lethal injection is ok
Firing squad works
Repatriate him to his chosen homeland of Afghanistan works, with a do not interfere order for all US military, and an understanding his has been stripped of his citizenship and to be considered either a non combatant or target depending on his actions in his new home country

SGT Bergdahl will likely not get any jail time from what I have read. If you followed this from the beginning it was clear this soldier has experience several trauma of some sort, beating, starvation, likely raped over the years he was held, who knows what else. The prosecution is not challenging some of the finding based on testimony from doctors and debriefs after his return to US hands. Is he guilty of leaving his post, yes but that's where it ends. I doubt he will get jail time, he will require medical / mental help for the rest of his life and going to jail and being dishonorably discharged will change that. I don't think the entire picture of the "why" he left will ever be released, so without the history of "why" he did it being available this will never be understood. I'm not saying I agree with his acts, but the consequences of his act are clear, torture at the hands of the enemy and now the possibility of spending another part of his life in another cell and the thought of confinement will be another strain on his mental state. The jail will need a 24/7 suicide watch on him.

As for the "Hair Piece" comments, well not worth the time of day to really put an effort reply.

In my opinion Bergdahl is guilty but his defense team is going to use mental issues and a poor chain of command, and then of course his heinous treatment as a prisoner while being held by the Taliban to get some sympathy and support.
In my opinion I do think that President Obama will pardon Bergdahl when he is convicted, and yes I say when convicted because in my opinion I feel he is guilty beyond a reasonable doubt.

The only thing that burns me up about this whole issue is the fact we negotiated with terrorist. That was the first step that has put the U.S. looking weak in the eyes of other nations. Especially to Putin. Give Taliban leaders for soldier who deserted his post. Put other soldiers in harm's way looking for him and later on performing swap in a valley with terrorist on both sides on the hills. No one can actually say what was kin Bergdahl's heart when he left post. Him being executed no because of due process and I don't know all the facts. I haven't seen anywhere stating his desertion, capture, whatever floats your boat, directly caused the death of anyone via search or normal ops. The truth is only known by him, whatever deity he believes in and his captors. I haven't heard any major propaganda from them concerning this as well. I don't know what demons he was dealing with, if he was a coward, stupid and idealist or made a mistake, but the fact is he was a captive in some form for a very long time. If the facts come out that he conducted himself improperly, then he should receive whatever punishment guided by the UCMJ. Executing a guy because of a perceived dishonor while service members who've murdered others get life sentences is a bit backwards. I don't know him, I don't have access to any information except what is published so I can't judge what he did.

If I were on the jury at Bergdahl's trial I would want to hear more from the guys in his unit...& learn more about the Patrols that tried to find him & Seals who tried to rescue him because there may be evidence Bergdahl may have tipped off the Taliban about these missions....If that is proven I would go with prison time but not death... But I am just an outsider on this one & never served in the Afghan...

I agree with him. Desertion in time of war has always been a death penalty offense for reasons easily understood by anybody on this forum. The misbehavior before the enemy charge I interpret as basically treason but lacking the Constitional prerequisite of 2 eyewitnesses to the overt act.

The UCMJ does provide for punishment up to the death penalty for desertion during a time of war. As far as I know though, the U.S. Military has only carried this out once, a young private during the Civil War I believe. As for Bergdahl, I don't see what good execution would do. Especially after trading prisoners to get him back. I don't agree with Trump on this, but I do agree with some other things I've heard him say.

I'll be satisfied with the results of his Courts-Martial, as long as there's no undue command influence exerted by the Pentagon or the White House. Those two entities have too much vested interest in the outcome. A guilty verdict would be public relations nightmare for the generals who hitched their careers to a certain politician, and said politicians trade bait fiasco.

Today's news says the Army is recommending no jail time based on time served in captivity. This is a clear twisting of the facts effecting the logical outcome. The Conviening Authority should require the case go to a General Courts Martial and let a board decide both his guilt or innocence as well as any punishment that might be forthcoming. I have enough faith in the UCMJ and it's process to be satisfied with the outcome. I don't not have faith in the Generals who have become political animals to insure their own survival rather than being concerned with good order and discipline in the force. I honestly think that he should receive more than what is currently being recommended; I also believe that a special court-martial is a little too light, given the circumstances of his actions. The charges put against him by the military. If it is proven that there was misbehavior in front of the enemy, then under that charge, he should be executed.

Most of you here are correct - 1) his actions don't warrant an execution, and 2) it's coming from a presidential candidate, so it's just his opinion (for whatever reason.

I however believe that he should either be executed (easier way out, no pain, saves taxpayer money), or have him in some penal colony for the rest of his life, doing hard labor (sounds more appropriate, so that he would "suffer" more, but spends more taxpayer money). Based on what I have heard of the story, I certainly wouldn't disagree. There are a million ways to be a coward in the military that wouldn't condone a death sentence, what he did isn't one of them. His actions resulted in the death of an indeterminable number of real soldiers. He not only turned his back on his oath, he turned his back on his country. He didn't just go AWOL from basic training, he left a combat zone, deliberately to find the enemy and turn over information. IF you want to say that "he didn't intend to turn-over information" which I personally don't buy, his actions still put him in that position. That being said, he deserves a speedy court-martial.... one that doesn't involve the opinion of the media, or a certain President, and then if half the stuff that has been reported about the incident prove true, he deserves a fast track to the firing-line.

I've done a lot of law, and one thing I absolutely learned is my opinion doesn't make a shitake bit of difference. What can I "prove" in court?!? Keeping in mind, this is the "recommendation" not the final sentance, there will never be a decision in this case that pleases everyone. Trump, despite having some great potential as a candidate in some respects...is commenting where he doesn't have a right.

Execution is severe. It's designed to ensure repetition is less likely to occur. In a battle-space, the knowledge that desertion can cost you your life may keep someone on the line. It may also result in mutiny.

From the evidence, I don't believe Bergdahl had any intention to defect, aid the enemy, or conduct treachery against the U.S. I do think he was someone who had too high an opinion of himself...too little respect for military discipline...and no respect for the lives of those whose proficiency in all of the above areas compelled them to attempt to "rescue" his sorry hide.

He should be punished-a reasonable jail sentence isn't too harsh. Death would be mis-applied, and set a dangerous precedence.

Absolutely. I think that this coward should be shot by firing squad or hung by the neck until dead. His actions directly caused the death of 6 servicemembers in the search for him. He knowingly abandoned his post, he knowingly walked off of the FOB, and none of which was performed under duress from outside influences. His email to his father shortly before the desertion should be the key in the lock to understanding why he did what he did. He was hoping that he would get captured by or be able to link up and join the forces of the Taliban, it's evident in how he talks about America and our "Arrogance". Not to mention the statements made against the United States in further videos. He violated the Code of Conduct. Not accidentally and without knowledge of doing such an action, but blatantly violated article V: "When questioned, should I become a prisoner of war, I am required to give name, rank, service number, and date of birth. I will evade answering further questions to the utmost of my ability. I will make no oral or written statements disloyal to my country and its allies or harmful to their cause."
He was not under any apparent duress in any videos, he looked to be well fed, to the standards of his captors at the very least. He was compliant and not defiant in his speech or actions. I would rather die than to say the things he said on camera.
In closing, yes. I think that PRIVATE Berghdal, I refuse to recognize this piece of human garbage as neither an NCO or a POW. To do so would discredit and dishonor all NCO's and POW's alike.

I would leave that up to the powers that be to decide his punishment, not someone running for President and looking for votes.
What needs to happen and what will happen are two different things.
What needs to happen is he needs to be tried by a fair and impartial court martial members. Then based upon the verdict punished according to what the crimes dictate, be it death or life in prison or whatever.
What is more likely going to happen is he will be charged for the crimes, possibly found guilty and then given a soft sentence to help justify the fact that the President made a deal with terrorists. It has been proven that all of the five traded have left Qatar. Some of them have been identified leading ISIS in Iraq and Syria.
Now, do I think he deserves death? No, it would serve no real purpose to kill him. Death for desertion was, when it first started being used, a tool to deter others from deserting. I think he should be locked away and through away the key. That would be a more fair punishment for him. Let him lament over the fact he betrayed his Country, gave intelligence to the enemy and was responsible for members of his unit getting killed looking for him. Bergdahl deserves due process like any other accused. The search for the truth may take some time.
Anyone remember in the 1980s Private First Class Garwood? He is often cited as the last verified American POW from the Vietnam War, Garwood was taken to North Vietnam in 1969, and reportedly was released in 1973 along with the other American POWs. However, he did not return to the United States until March 22, 1979. He was convicted on February 5, 1981 of communicating with the enemy and the assault of an American prisoner of war interned in a POW camp. It took several years to bring charges, conduct a courts martial and convict him. Hopefully, justice will eventually be served on Bergdahl.

In my opinion only knowing what I've read or heard from his squad... He should also be held accountable for the deaths of those who died attempting to rescue him.

The UCMJ has the process and charges all laid out in print. If it comes to it and he is charged with violation of it, then the full penalties of the UCMJ should be applied to him as to any other Service Member. No exceptions and no leniency should be shown to him just because of his circumstance. But, at the same time, I believe other charges should be brought to him over the men that were hurt and killed along with the wasted time of their search trying to find him the day he walked off his post.

Considering Trump has no official position in the chain of command now or ever how could he? Even if elected he would have to insert himself into the trial process to "damage" his chance for a fair trial.

If he were elected I think the Army would have a freer hand to pursue Bergdahl more vigorously than under the current regime. Obama hailed him a hero (remember, he served with honor and distinction) and his family was brought to the White House for their moment in the sun. Talk about impacting the chance for a fair trial. Fair goes both ways. Justice has a blindfold on for a reason. If anything, this administration has kept Bergdahl from facing the full force of military justice which is actually impacting the ability for a "fair" trial. Are you concerned about that side of fair as well?

SFC Private RallyPoint Member Nope, I don't think he's damaging Berdahl's chances of a fair trail and in my person opinion and only a personal opinion, Bergdahl is as guilty as they come. Not to mention that he continues to collect an E-5 paycheck and does not deserve such. He was hailed by President Obama for being a hero and he is a zero! He caused us to lose countless service member lives trying to locate and rescue him not to mention that we released several high ranking members of the AQ in exchange him. What happened to that thought that we don't negotiate with terrorists?? As far as I am concerned, Bergdahl's as guilty as sin! The elections involving Trump and his comments have no impact other than probably upsetting the supporters that believe that Bergdahl is innocent and he never did anything wrong!

Yes.

The more Public figures you have calling someone a Traitor before a trial even begins, the harder it is to have a Fair Trial. Add in the fact that he is NOT being tried for TREASON (Actual charges, Misbehavior before the Enemy and Desertion) the harder it becomes to fight the actual charges presented.

Trump (among others) is trying him in the "Court of Public Opinion" as opposed to a "Court of Law" much like most of the members of this Forum have. The Courts Martial has not resolved, and we do not know the full facts of the case. I would pray that none of the people here who have expressed his guilt never served on a CM or in a jury nor ever do.

He should have already had a fair and speedy CM by now. Prez. Obama's Rose Ceremony was entirely idiotic. It violated every prohibition against exercising 'Command Influence' on an ongoing action. He should be executed in PUBLIC and it should be a very slow, painful death. He is a disgrace to America and the uniform. what is this guys crime? if what he says is true and he was planning on going to next closest FOB then that isn't desertion, its not smart, but its not desertion. If on the other hand he decided to leave and never come back then that is desertion but it is also strong evidence of mental instability (I mean this is Afghanistan not Tahiti or the south of France). In either case, execution is morally wrong. I think a lot of people are just looking for a reason to be pissed off, some of our political leaders have used him as a pawn to discredit other political leaders; but this doesn't take away from the fact that this is a real-life flesh and blood person subject to bad ideas and mistakes just like the rest of us.
