Now whether that individual would have hinted towards the deal or blew the whistle about deal doesnt matter. But I definitely think if he [POTUS] had alerted Congress about the deal then things would have been extremely complicated.<br /><br />Plus I think that decision really fell under the premise of the inherent right of the President. There are some situations that require only the President's call. Negotiating with terrorists to get your man back; no matter how much I don't like it, it still falls on the President, because at the end of the day, he still has to make the decision on whether to go or not. It is obvious he wanted to chalk it up as a victory but did not do a thorough check of SGT Bergdahl's AWOL/desertion circumstances. Regardless weither or not they were notified we just gave the taliban a great victory and ruined any progress we have made in the last 10 years of war in Afghanistan. They now have a great boost in morale, a win over the United States for recruiting propaganda and five of their top leaders back to plan and execute future attacks on our Soldiers and possibly our own soil again. If they wanted to get Bergdahl back they should have sent in a Special Ops team and extracted him by force, they found binladin, they could have found him too. I truly believe this is going to bite us in the a$$ down the road. POTUS should have notified Congress. IF and I use the word IF they were required to be notified and were deliberately not notified, then we get into that realm of "well I don't fell like following this rule or law" I'm just going to over look it and where does it stop, who decides which laws can and will be sidestepped. If we cant trust our CinC to obey the rule of law, how can we expect others to follow the law? <br /><br />As a caveat to this, it has been said that the Art 2 of the Constitution gives the President the right to act unilaterally if circumstances warrant then there is NO legal issue. However he doesn't have to justify that to us in the military, but will to Congress. <br /><br />But speaking as a private citizen I would want to know that my elected leader is following the law and that he/she wasn't just picking and choosing.
