Even while taking birth control pills there is still the possibility of a pregnancy. Period !! <br /><br />That said mislabeling any type of medication is a serious offense and the error must certainly be investigated and corrected. But the burden of proof is on the parties who claim that this was indeed the reason for their pregnancy. I know some people may feel overwhelmed by having a baby but Who's to say that the birth control would have stopped it anyway.
