A former U.S. soldier sentenced to death for killing two fellow soldiers and injuring 14 others in an attack in Kuwait is pinning his hopes of staying alive on an argument jurors should have never seen his diary.

Attorneys for 43-year-old Hasan K. Akbar argued on Tuesday that the one-time sergeant's writings, which include details of how he converted to radical Islam, were so inflammatory, that without the proper context, jurors were most likely to focus on the most damaging parts while considering whether to impose a death sentence.

"They didn't present the information in any meaningful way," said Lt. Col. John Potter, a military lawyer arguing the case for Akbar before the U.S. Court of Appeals for the Armed Forces in Washington.

Akbar was with the 326th Engineer Battalion of the 101st Airborne Division based at Fort Campbell, Kentucky, when he was sentenced to death in 2005. He killed Army Capt. Christopher S. Seifert and Air Force Maj. Gregory L. Stone in Kuwait two years earlier during the early days of the Iraq war.

Prosecutors say he threw four hand grenades into tents as members of his division slept, then fired his rifle at soldiers in the ensuing chaos on March 23, 2003. A military jury at Fort Bragg, North Carolina, convicted Akbar and handed down the sentence. The military has not carried out an execution since 1961. Akbar is one of five ex-soldiers facing a death sentence, the only one for actions in the Iraq war.

Potter told the judges the defense failed to prepare witnesses and errantly let jurors see Akbar's diary, which contained multiple anti-American passages.

Potter said allowing the jury to read the diary "eviscerated the defense in any meaningful way."

"We think the diary, there's no tactical reason to submit the diary," Potter said.

In one entry dated Feb. 23, 2002, Akbar wrote that he believed staying in the Army would eventually lead him to prison.

"I had a premonition that if I re-enlisted I would find myself in jail. That is probably true because I already want to kill several of them," Akbar wrote of his fellow soldiers.

The judges hearing the case focused on how the diary fit into the rest of the defense strategy, asking whether attorneys did anything to put the passages in the context of Akbar's pre-military life or any mental issues he may have had.

Potter noted that the defense put on 38 minutes of mitigation evidence and argument and didn't present any testimony from his family to humanize him. Instead, the lawyers failed by letting jurors pick through the diary and focus on the passages that left their client in the worst possible light.

Prosecutors said Akbar's defense attorneys acted in his best interest to try and prevent a death sentence from being issued in one of the "most egregious offenses in modern military history." The defense attorneys focused on the most viable arguments and witnesses, Maj. Kenneth Borgnino said.

Prosecutors noted that much of Akbar's family likely wouldn't have made a good impression on the witness stand.

The judges did not indicate when a ruling would be issued.

He had his day in court, he was convicted, now get him out uniform and onto that table. One of his victims was a friend. Firing squad is what he should get but I will be ok with LETHAL INJECTION. I can only hope he gets one of those bad batches so it takes just a little longer. Sorry but Major Stone was a good man. Knew him when he was in the Hawaii Air Guard.

I posted this thread awhile ago about this case. I remember that night like it was yesterday. The sky was unusually dark. I remember not being able to see any stars in the sky that night which we all know was not normal for Kuwait. I remember the chaos that followed. I remember CSM Womack establishing command and control over the BDE HQ area; coming into the command tent and saying we were authorized to use lethal force on anyone that didn't identify themselves. I remember the next morning waking up and hearing the report that CPT Seifert and MAJ Stone were killed. Shortly after Akbar was captured, he was put on a Blackhawk and flown off Camp Pennsylvania. Akbar is a coward. He earned his new title of "Inmate" which is how I refer to him. I proudly wear my remembrance bracelet for CPT Seifert everyday. Akbar deserves to get the needle.

Okay, sorry for the rant. If anyone would like to know more about what it was like that night I highly encourage them to check out the book that CSM Womack wrote "Embedded Enemy". The first few pages of this book were written just days after the attack. The book is out for sale on Amazon and Barnes and Nobel. I remember reading about this incident, Who cares about the diary and writings. He had his day in court and was found guilty by a jury of his peers.

He did the crime there is no denying there were eye witnesses of him shooting and murdering his fellow soldiers.

It is quite disturbing not only in this case, but a myriad of others that we tax payers financially support decades of incarceration and appeals for folks who are deemed guilty over and over. I hadn't heard of this before but any serviceman who turns on his brothers and sisters should have the harshest of punishments. For me that means life in prison, not death. A few points and historical facts:
- Military justice is administered for a few different reasons: punishment, deterrence, rehabilitation, and good order and discipline.
- PVT Akbar received due process and was properly convicted by a military court martial.
- The issue of PVT Akbar's diary is a technical issue and a minor issue at best. If I were a court martial member, I would have convicted him on the facts that he killed 2 and wounded 14 alone regardless of what he wrote in his diary or what his motivations were.
- PVT Akbar deserves to be executed for the crime that he committed. Goes to punishment and deterrence.
- The US Army has not executed a Soldier on death row since about 1961.
- There are about nine Soldiers currently on death row at Fort Leavenworth.
- Unfortunately, the probability that PVT Akbar will be executed for his crime is very low at best regardless of how the US Court of Appeals rules. Unfortunately, the same can be said for former MAJ Hasan. These two will most likely die of old age in military prison. If so, this is a crime as well.

I'm just not sure if I'm ready to read it and live through that night again. I'm actually hoping to go to Chris's grave site for the first time in 10+ years next weekend. As of 2012, in Texas, the cost of the lethal injection cocktail was $1286.86. I'm not sure how much the Government pays for that- probably a lot more.

With that being said, wouldn't it be cheaper, and to save the Taxpayers some money, to just go back to using a firing squad? A 5.56 NATO round would be very cost effective.

What exactly is the argument here? He was convicted of the killings and at this point the defense isn't denying that he did it. The sentence is fine based on that alone and should still be the death penalty.

I'm fairly sure the jury wasn't thinking "Oh he only threw grenades and shot at fellow soldiers, that's not to bad. Wait he wrote angry things in his journal to? That's going to far, he needs the death penalty for that."

A firing squad is for the execution of a soldier. But when that soldier has disgraced his uniform. Either by desertion or turning on his own killing and wounding them. At this point a firing squad is no longer in order. It is hanging that has always been handed down for these crimes. So I think we should give this sorry ass punk a short rope. Then cut the bindings from his legs and let him dance his little jig. Get some bottles of champagne and start popping the corks. Call it a celebration dance lol. Make it last a long time.

My platoon could not fathom the idea of doing something like that to our own. - One great thing about the infantry....you learn to take down the enemy without remorse. To not lose sleep over it. The process to execute a military prisoner is convoluted. First off it requires the POTUS to sign the Death Warrant. The POTUS does not even see the warrant until a lot things happen. First the inmate has to exhaust all appeals at the military level starting with the service's Court of Criminal Appeals, in this case the Army Court of Criminal Appeals. Then it moves up to the Appeals Court of the Armed Forces. Once all appeals have been exhausted at the armed forces court a request must be made by the conniving authority to seek the Death Warrant. Then that gets routed to the Service Chief, then to the Under Secretary of the services legal affairs, then to the Secretary of the Service and finally to the POTUS. Where the chain can be broken at any time through the routing before it hits the POTUS. Then of course the POTUS may opt to deny signing it. Then the scumbag has to wait for a pro-DP president to sign it after it goes back to another submission from the beginning. If the POTUS signs it the condemned can now chose to appeal in the civilian circuit courts. Then after that gets exhausted they apply for a writ of cert with the SCOTUS. Then the cycle goes around and around until they finally exhaust all appeals and there is a Pro DP POTUS. Then at that time they may finally be executed.

The whole process takes a long time, decades! In reality they will most likely die of natural causes before that occurs. The only way to speed it up is if the condemned pulls a McVeigh and the POTUS is not against capital punishment. Even they are for it the POTUS's tend to try to stray away from it until their second term. We haven't executed a Federal Prisoner since McVeigh.

Being a soldier and having deployed in support of this country I may not have always agreed with the things that lead us to deploy but I have supported the decisions of my commanders. If you have joined the military you are automatically saying you will die for your country, If you do something like this you deserve to pay with your life. It amazes me that Akbar even made it to trial. The American taxpayer has already spent too many resources on this man. Lethal injection is far too expensive. Why not execute him with a captive bolt pistol? It's simple (no team of doctors or experts needed), results in instant death (no cruelty), and it's cheap. Any savings could be used to fund widespread telivisation of the hopefully unceramonial execution.

The review and appeal process has been extended way too long in my view. The likelihood of a death sentence is small, but is warranted in this instance. American justice needs to be viewed as justice.....especially for the victims. In this case, those who were injured and killed are victims but also all who have honorably served and are honorably serving are victims. I am reminded of the saying that "justice delayed is justice denied". This is true of the victims also.

I won't vote up or down on this, but I will state this Sergeant should've got out at the end of his tour. His religion didn't have to be an excuse for his actions, it is his choice and the consequences is on him. I don't understand why his diary is having the effect that it is. If anything, it shows intent and that his actions were premeditated. Why is it so difficult, and takes so long, to prosecute these people that were caught in the act, "red-handed." Sometimes I hate our justice systems...he doesn't deserve death by firing squad, that's too quick. He deserves to suffer an agonizing death. Just my .02.

It's sad, and heartbreaking for the families affected. I'm not sure a quick death is good enough, I'd almost rather know he was put in a life sentence in isolation. Truth is and what always scared me was the type of "some" people that are recruited into the Military, a lot of people I knew said they had joined to avoid jail, and several others had obviously in their previous civilian life had been affiliated with gangs. I joined because I love my country, and I wanted to serve with those type of people. Why do we allow people like this to serve? I understand this was not his reason for his actions but the military in general in my personal opinion should place stricter standards on who they recruit, stop worrying about soldiers who have or want tattoos that are good faithful soldiers, and focus on recruiting the right people rather than numbers of people. This man deserves everything he has coming to him, and I hope the families of the victims, and the soldiers in his unit can find peace in his death.

We use the term radical Islam. In my Belief Islam is the Problem. Most other Muslims turn a blind eye to terrorist. To defend the US we need to put pressure on the Muslims at home. Wow I thought this case was long over, I was deployed when this happened, we were getting ready to cross the lines into War.This was one of the first killings we heard about BUT when we first heard we just knew it was one of the enemies. I think we all were in shock to hear it was one of us. Its a horrible shame to have to go to combat and not only worry about the enemies outside the gate but inside too!! And they wonder why so many Soldiers come back with PTSD and have trouble sleeping.

He did have his day in court, but thankfully we have a justice system (even in the military) that allows for appeals and a reconsideration of the facts.

I don't condone what this person did, but I am thankful that we have the liberty to have our appeals heard. It's what we fight for as Soldiers. Fair and impartial justice are cornerstone of our Republic.

As a paralegal, I can tell you that accused Soldiers are afforded their rights which often times are more than what civilians get. I don't think the Court of Appeals will overturn his conviction based on allowing the diary into evidence. Military Judges are usually very cautious and follow the Military Rules of Evidence during a trial.

I had a buddy who was working as an embed journalist and was one of the first guys on the scene, helping the ones who were wounded.
Another friend who was mobilized was a Family Assistance Officer for a family of one of the two who were killed. The Father kept asking why his son was not getting a Purple Heart. The incident was still under investigation and all my buddy could say was just that. He was the second Family Assistance Officer, and was soon replaced as the family was quite distraught and wanted answers to their questions.
This guy should have been taken care of long ago.

See... I'd do more than just put a bullet in his head. That would be considered merciful to me. Treason, which in my mind is exactly what he did, deserves a special kind of treatment that would instill fear in all from trying the same thing.

Torture is child's play compared to the things I have in mind.

But since we live in a world of "being nice" and "make it not hurt", even though he caused way more heartache and suffering for those he injured and the families of the ones killed. So instead, there's a few medieval execution techniques I would love to see implemented.

Just to name one: Drawn and Quartered, in the full sense. Drawn by Horse, Hanged by a noose, Disemboweled, Quartered by Horse, and Beheaded. Note, the hanging was not till death. This ensures he feels every bit of it, until the beheading.

Treason is a serious offense and we take an oath to protect. He violated that oath and disgraced the military willingly. He deserves more than just a bulle, and should be set as an example for all those who are having the same troubled thoughts he did. Go Get Some Help, or Die Like He Did!

The constitution applies to citizens of the US when not in uniform. If a crime is committed by a uniformed citizen, in a warzone against fellow soldiers,sailors,or airmen,it falls under the purview of the military tribunal and the UCMJ. Civilian courts have no say in these matters. The punishment should fit the crime commited and shunning and keelhauling would be too gentle for this piece of trash.

It does not matter that they read his diary. What he did was flat out wrong and should be seen as a terrorist attack. He killed our fellow brothers/sisters in arms and deserves to receive the death penalty. He does not deserve to wear the army uniform or even be called a soldier. His diary gave insight on his state of mind in the days leading up to his abominable acts and was a great piece of evidence for the jurors to see. Personally I don't think the diary had any significant impact. The fact remains many witnesses saw him toss the grenades and fire his weapon on Soldiers. The acts resulted in death.

UCMJ Article 118:
Any person subject to this chapter whom without justification or excuse, unlawfully kills a human being, when he- –
(1) has a premeditated design to kill;
(2) intends to kill or inflict great bodily harm;
(3) is engaged in an act which is inherently dangerous to others and evinces a wanton disregard of human life; or
(4) is engaged in the perpetration or attempted perpetration of burglary, sodomy, rape, robbery, or aggravated arson;
is guilty of murder, and shall suffer such punishment as a court-martial may direct, except that if found guilty under clause (1) or (4), he shall suffer death or imprisonment for life as a court-martial may direct.

His act of taking two grenades and a loaded weapon to commit the acts show premeditation.

The UCMJ should be used and NO civilian court system, the traitor committed a crime against his own during combat and should be tried for treason which is death by hanging. This type of justice should be used to set an example for all those that "feel" they need to exercise their "rights" under OUR Constitution!

This is not a civil matter for the civilian courts to decide, it is clear and present danger of a system that has allowed folks to get out of line and not flow with the system.

In March of 2003 I was with a group of Observer-Controller/ Trainers embedded with an assigned Company for 7-10 days at a time. We had just finished when we were assigned a new Battalion and told to make contact that evening to begin operations the following morning.

The Platoon I was assigned had already bedded down for the night, so I sat up with the PSG and a cup of hot coffee for a few hours going over what we would be doing in the morning.

That morning came far too early as the grenades went off about 100 meters away.

I was part of the medical effort and assisted in the search for what we originally thought were a small group of infiltrators.

To our HORROR, we found out from the 1SG that the one person responsible had been found cowering in a SCUD bunker nearby.... and it was a recently converted US Soldier who had "gotten religious and told everyone he wanted to go home again".

I will never forget that day, those terrible hours of our frantic work with everyone, and the final outcome of finding out that so much damage had come from an American soldier.

Get that uniform off of him
Put him in whatever color he gets now
...and give him what he wanted all along

He should have been dead years ago. Our weak kneed approach to crime and excessively slow judicial process is a major contributor to why incidents like this occur. If executions were re-instated and swift execution of punishment after speedy trials were to start happening there would be a drastic reduction in crime across the board. Even more so at the civilian level when individuals consider the most likely scenario of punishment for the crime committed.. murder for example has VERY lenient sentences and that is only if convicted in the first place.

Why? This man committed bold-faced MURDER of his brothers in arms....Soldiers that trusted him. This is absolute horse-shit that you should exempt a man's PERSONAL diary from the face of a criminal trial. The fact that this man made it TO trial is a testament of the restraint of those around him.

There are no secrets from the chain of command, and there should be no secrecy when it comes to allowing them to make a decision. NEVER ONCE, even in privacy or thought said, "I will KILL you." or "I want to kill you." Why? Because as a Soldier, we are given that capacity, and are never to take that decision lightly. Even if you are writing it "just to vent", the fact that you are saying this in thought means that the idea has already implanted in your mind, and you need IMMEDIATE intervention (ESPECIALLY in a war zone!!).

We have dragged these trials out for YEARS on stupid technicalities. Should Nidal Hassan be forced to shave or allow him to grow his beard while he's in a military prison? Can we look at this guy's "pretty in pink" personal diary? Both sides do their best to face the music. If all you can say is "He read my Hello Kitty Journal", then let's get on with justice and move forward. These families, friends, and fellow Soldiers don't need their emotions dragged through the shit any more than they already have.

I fail to see how his journal is damaging. I would think the hand grenades and bullets would be adequate for guilt.
If he was arguing that he will be executed due to being a Muslim (religious discrimination) then he should have played that card. Admit guilt but try to demonstrate that other soldiers that have killed fellow brothers in arms have not been put to death. Sad case regardless, I just hope we don't waste too much money on his trial, incarceration and sentencing.

Why isn't he dead yet? Everyone knows he rolled a grenade into a tent with the purpose of killing/wounding as many as possible. He never even tried to deny it. What further proof do you need?

As for the way he should be executed, I think they should tie him up and throw some grenades near him to wound him but not close enough to kill him. After he writhes around on the ground for a while, someone can shoot him a couple of times with some small caliber rounds (.22 for example) then they can just leave him there until he bleeds out.

In my opinion, he should not get the death penalty, as it would give him the "privilege" of being a martyr for radical Islam. On the other hand, giving him a life sentence would provide him opportunity to recruit others to radical Islam. The answer to that is to give him life in solitary confinement, with no possibility of parole, no family visitation (after all, two of his victims can't see their families anymore), and certain no conjugal visits. Give him a room that is completely barren of anything other than a mat, a wool blanket, a small pillow, a hole to urinate and defecate, single ply toilet paper, and one hotdog MRE per day (ONLY the hotdog MRE, everyday, no other options).

I arrived with 1st BDE 101st Airborne (Air Assault) on the morning after this attack 23 March 2003 from Camp New Jersey. I was the PSYOP Detachment assigned to the BDE for OIF. I was witness to the aftermath and subsequent investigations that followed this attach while still in Kuwait. The attack was well planned and though out. He turned off the generators so the lights would be off outside the pads. He threw grenades into the senior leadership tents one at a time and was shooting them as they ran out cover. Capt. Christopher S. Seifert and died of gunshot wounds. Air Force Maj. Gregory L. Stone died from a fragment of the grenade tossed in his tent, he bleed out on the flight to the hospital. Several others were seriously injured including the BDE CDR then (COL) now LTG Ben Hodges. He was only discovered because he was bleeding from one of his own grenades. When confronted, he confessed to the attack. He was in charge of the munitions that evening. Those in the BDE are my friends and we served in combat together. A firing squad is absolutely appropriate. This is a PC move because of the current administration views on "terrorism" or rather the lack of it.

There is nothing that should change the outcome of that trial. He got a fair trial and was found guilty.

For everyone pitching a fit over him being in uniform...this picture is from the trial in April 2005. File photos taken between 12-21Apr are used when ever this comes up. It is Army Standards to have all parties to courts martial to wear (then) Class A Green Uniform or (now) ASU. He was convicted on 21 Apr 2005. He now wears a prison uniform. When someone is sentenced following a court martial, that individual goes directly from the court room to the confinement facility, literally. They do not even pause. No wardrobe change. Other related items: Award revocation AR600-8-22 page 8. Revocation of Air Assault Badges page 9. Prohibition of wear of awards AR 670-1 para 22-3.

I am lost in trying to understand why he is still alive. Ten years is a very long time. It is like when a child gets caught doing something and the child finds many new and ridiculous ways to change the outcome (the punishment). Get it over with and move on. I believe life is very precious, but the lives this man took were very precious as well. The threat must be exterminated. How is the wait ten years long?

Ok while I'm black I'm going to say that race has nothing to do with this issue. The bottom line is he betrayed his country and his fellow soldiers, killing two and wounding 14 others. Maybe this thinking is old school but the decision to convert to islam while repugnant to me its not my decision but his decision to betray his country and fellow soldiers amounts to treason and therefore punishable by death. This case is truly meriting the death penalty if any case ever was. Also the fact that he is allowed to wear the uniform of the US Army is an affront to every man and woman that has ever worn the uniform honorably. He should be stripped of his uniform and presented to the judges in prison jumpers.

When I looked at the name of this soldier and I looked at his facial structure. I knew immediately that he had to have had his name changed legally and someone somewhere should have recognized this as a sign of impending trouble. It sticks out to me like a BIG RED FLAG. I'm surprised that the event didn't happen before he reached the rank of SGT. Anyone/Everyone should have been able to see there was something not right here. If any of you are interested his real name is Mark Fidel Kool. This was a PREVENTABLE EVENT and it angers me that no one was looking at him really hard all the time.

I will explain why. The second Imam (phrophet) was named Hasan referred to as Holy Prophet Hasan, Karim means generous in arabic and akbar means the great. Translating this name is Hasan generous the great. If you look at this name and apply knowledge about conservative/radical Islam then you will know this is a large sign. Translating his name to Arabic it is literally The Great Generous Hasan. Saying this inside the culture it means he is going to give something great to the movement. He is putting himself on an extremely high level with this name. Someone just needed to read it.

There is only one way to effectively deal with any terrorist. As one deals with a rabid dog, you kill them and everyone who supports them. Kill them in there homes or any where else you find them with out regards to borders or boundaries, as Usama Bin Laden was killed in his own bedroom. First of all he shouldn't be allowed to wear the uniform anymore. He already disgraced it. Second his diary shouldn't even be a concern. I don't see how the diary could be misunderstood or taken out of context. Its in his own handwriting and words, so what is there to misunderstand? For whatever reasons this scumbag killed 2 and wounded 14.
And what difference would it make if his family took the stand? Would you expect any of them to not say that he was a good person who went to church, who was respectful to others? Unless your family member is a total, evil person then your never going to hear anything bad come from a family member.

I remember when the incident happened, and I am mildly surprised his sentence hasn't been resolved yet. Firing squad would be very appropriate in his case, but just for kicks, let's be sure we oil all the rounds with bacon grease first.

So after being involved in the legal system and spending more time in a court room than I ever thought, I've come to a few conclusions based on my own personal experience and observations. I've never been involved in criminal matters but nonetheless your mileage may vary.

Judges get it wrong sometimes because they are human and humans make mistakes. The prosecutor's job to to find the defendant guilty and the defense counsel's job is to exonerate the defendant or do as much "damage control" as possible. Regardless of personal feelings, emotional bias or the politics behind it, the simple reality is that we all have rights. One of them is being innocent until proven guilty.

Now I'm not saying that he isn't guilty, nor am I trying to mitigate or minimize the tragic events that came to be that day. I'm not saying that he doesn't deserve to have his testicles rest in a colony of fire ants (or whatever else Quentin Tarantino's sick, twisted and convoluted mind can conjure up) but we, as our own society, have created a system where there are safety mechanisms in place so that we can ensure that justice is served accurately instead of expeditiously.

In criminal matters and even civil or domestic cases, there are things called "Mitigating" and "Aggravating" factors. Mitigating means that there are facts that reduce the seriousness of the crime/infraction/offense; conversely, Aggravating means facts that increase the seriousness. The simple fact is that the legal process affords him the right to seek an appeal and with death being Option -A, I sure as hell don't blame him for trying to seek Option -B.

For those who are calling for swift death, put him in the ground, etc, etc, I ask the question, "Are you afraid that this convicted man is really going to prevail in his appeal?" I mean is killing him 5 minutes from now or even 25 years from now going to bring back the deceased or somehow undo the damage that's been done? Great, have this dude ride the lightning, get ballistically ventilated or evenly distributed about with extreme prejudice; then what?

You have to deal with the pain and close that chapter in each of your respective lives (for those who were directly and indirectly affected) in your own way regardless of the outcome.

Let's also take a look at how this could have been prevented if we're all going to armchair quarterback this thing. Is the leadership culpable for this at all? Were there warning signs? I would think that during pre-deployment SRP that a religious preference listed as "Muslim" or "Islam" might be a raised flag that's worth looking into just a bit. I mean you don't just wake up one morning and start shooting your own. Someone knew of or had to have seen warning signs and nobody took action.

Going back to the appeal and trial issue. Part of a defense lawyer's job is to make sure that the prosecutor presents his case in accordance with the rules of evidence, chain of custody and that all of the I's are dotted and T's are crossed. If proper procedures are not followed, then the foundation and the integrity of our legal system will crumble.

The long and the short of it was that I had my ex-wife caught, blatantly violating our parenting plan and absconding with our children. The trial court judge failed to rule on the required factors concerning child relocation. Additionally, she failed to properly follow the court procedure. The most egregious failure of the judge was that she ruled against me and entered an order that completely blocked my access to the Court in its entirety. She essentially took my 14th Amendment Right (The whole "Due Process" thing) and wiped her ass with it.

Fortunately, I had an attorney who was educated on the laws and statues. It was a year later that I sat in the courtroom with great pleasure as I listened to a Superior Court judge recite, into the court record, how she failed and that her ruling was incorrect because she overstepped her authority.

So in closing, let's all take the emotion out of our comments as I'm sure that all can agree that fro those who commit crimes shall be accountable and answer for their actions. However, prosecuting and navigating the legal system is a business process that can only be based on facts, evidence and the laws/procedures that govern. Justice must be blind in order to be just and true, let things play out.

To me Religion per say isn't at play.What I mean is if he converted to another religion and it went against his new beliefs,than why didn't he simply not reenlist or take a hardship discharge.Radicalization and extremist views come from warped individuals who have ill intent to do harm to people who don't have their views.They use Religious teaching to authenticate their case,to justify it.Religion is a very powerful tool and our Founding Fathers knew that.A diary is a look into a state of mind.Im not his judge.But I do have a question what makes people radicalize,whistleblow,or leave your post?

The diary would have made no difference to me were I on the jury. The overwhelming facts were that he killed two and wounded fourteen. I don't care if his reason was religious, political or he got out of the wrong side of the bed. It was fratricide that should have been dealt with swiftly, for good order and discipline, as a deterren, and as justice for the families of the dead, the wounded and all the service members who were there and then had to mount an invasion while still grieving and having their head space and timing messed up because of it. Not to mention that death is the prescribed punishment under the UCMJ for his crime.

As a Lieutenant for the Ohio Department of Rehabilitations and Corrections I was very familiar with the conditions that death row and supermax inmates were housed in. It's a terrible way to live but many inmates are happy to be living in those conditions rather than being executed. They get a religiously appropriate diet, you aren't supposed to touch their Quran or prayer rug, it's all about their rights. The problem is, no matter how you try to keep them from hurting prison staff, they have 24 hours a day to figure out how they can. They mix feces, urine and caustic substances and throw it through cuff ports/food slots to try to get it in eyes and mouths. They break the razor off disposable razors and melt it into toothbrushes to slash staff. They break off the razor and hide it in their mouth to do the same. They make shanks out of almost anything. They are also very manipulative and prey on week staff members for favors. They take their time to befriend them and gain their trust and then they can get them to bring in cell phones to coordinate escapes, tools to escape or maim staff etc.. I could go on and on, but the bottom line is they pose a danger to prison staff and everyone else should they escape and that's unacceptable If it's because we are wasting time and money on endless appeals. They should get a fair trial, one appeal and then the sentence should be carried out. And for those that worry about giving him what he wants and making him a martyr, I have no problem with a firing squad with bullets covered in pig fat, then let him know he won't be clean enough to meet his Allah and let the world know how it was done to deter any more of the same type of attacks. I don't think that would betray our legal system by being cruel and unusual. May as well put Major Nidal Hasan (Fort Hood shooter) next to him for the same treatment!!!

It sure felt good to bash the hell out of the keys while I wrote this, but my blood is still boiling and I know I won't get to sleep for hours...

OK, I'll clearly never get placed on a jury. My views on justice are rather draconian, I view this as an assault on family - as his victims were brothers in arms. As such, it should be a family matter. I would treat this just like I would treat someone who hurt my son or daughter.

Put this man in a room with the family members of those he killed for an hour and grant all of them amnesty for any actions they choose to execute. They'd need a sponge to get him out of the room once justice has been done.

Having known one of the mothers, of an injured soldier that was in the tent during this horrific episode, and critically injured in the process, but has since recovered and remains on active duty, the death penalty is the right call, forget the diary, the guy did it. For those of us who experienced this event, no punishment is sufficient for this person. I'd imagine the same is true for most who experience this sort of tragedy. Stories like this piss me off. This is pretty simple, he committed treason and espionage, and actively murdered soldiers.

The fact that there's discussion about his diary or any other technicality is a mockery of UCMJ and the justice.

It's important to show respect and honor your adversary, and expect them to return that to you. He should be executed as an enemy combatant, not in some spectacular fashion, but in the way of his own people, beheading. The Geneva convention and rules of civilized warfare only work if both sides agree to follow them. Which seldom happens.

Send a message... that we will play by the same rules as our adversary. They have no issue hiding behind civilians and collateral damage. I say if they want to fight a gorilla war, we respond by fighting like we did in WWII at the battle of Dresdin. In four raids 700 bombers dropped 4,000 tons of bombs and we leveled 1,600 acres of the city. Today we could accomplish the same in one night. War is brutal and offensive... every time we don't fight it that way it turns to shit.
