Garry Swanner was in his underwear as he limped along the hallway of his Strawberry Plans home toward an unknown sound that had roused him from twilight sleep.

He had snatched the .40-caliber Glock semi-automatic pistol from his bed stand as he pushed himself out of bed to investigate the thud about 10:45 a.m. The 48-year-old man’s home already had been targeted multiple times by burglars and he wanted to be ready if another theft was underway that April 29 morning.

The Knox County district attorney will not prosecute a Strawberry Plains man who killed a burglar coming through his living room window.
