First of three parts

Top Pentagon officials and a senior Democrat in Congress so distrusted Secretary of State Hillary Rodham Clinton’s 2011 march to war in Libya that they opened their own diplomatic channels with the Gadhafi regime in an effort to halt the escalating crisis, according to secret audio recordings recovered from Tripoli.

The tapes, reviewed by The Washington Times and authenticated by the participants, chronicle U.S. officials’ unfiltered conversations with Col. Moammar Gadhafi’s son and a top Libyan leader, including criticisms that Mrs. Clinton had developed tunnel vision and led the U.S. into an unnecessary war without adequately weighing the intelligence community’s concerns.

“You should see these internal State Department reports that are produced in the State Department that go out to the Congress. They’re just full of stupid, stupid facts,” an American intermediary specifically dispatched by the Joint Chiefs of Staff told the Gadhafi regime in July 2011, saying the State Department was controlling what intelligence would be reported to U.S. officials.

[EDITORIAL COMMENT:- Has my memory slipped or is it still illegal for government/military officials to give confidential information to other countries unless specifically authorized to do so? On the other hand, I guess that one could conclude that the Democrats are just as inept as the Republicans and that NEITHER of them is capable of running the country for any purpose other than getting themselves re-elected. What say you?]

To me its not a republican vs democrat issue anymore. To me its a who is hooking my campaign up with money issue. I would like to see them govern for the masses and not for the few. I would like to have the confidence that the decisions are not being made with an underlying motive to hook a brother up at the cost of the nation.

Subverting your country under almost any circumstance could be considered treason. We have had spies that spied for allies (Israel) against the US and they were tried and punished. It is not done very often because of the trial that needs to occur. Information/sources/techniques can be revealed through the process.

The realilty of a treason charge is a treason trial for the officials you want to prosecute. A trial requires evidence, witnesses, forensics etc. It can expose things no one (including Obama/Clinton) want in the open about their activities too.

Clinton/Obama have been wrong on so many issues that digging into an issue like this in detail will likely reveal their infamy for all to see. That might be why you are seeing no one pursuing this very hard except the far left who do not understand what they are doing anyway. My guess is Clinton and Obama were so wrong on Libya they want to bury the discussion. A trial for treason will not do that and might reveal more treasonous activity.

The persons involved are guilty of something. I don't know what (if any) laws were broken, but the persons involved were, at the very least, stupid and showed very poor judgment.

On the other hand, I can not call this treason. The actual law (that I found) is 18 US Code 2381, and reads:

"Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title ... blah blah blah."

I don't see any of the criteria for treason. "...levies war..."? Nope. "... aid and comfort..."? Nope. Stupid, short-sighted and unprofessional. But treasonous? Subversive? In my opinion, no.

Now, let's look at this honestly. You've got members of the Pentagon and a Senator (Democrat, by the way) who are talking to Libyans saying that they don't agree with the State Department. None of these people answer to the Sec State. They're outside her "chain of command".

I think it's a really stupid move to show dissension in government communications, but is it illegal? If the JCS sent this emissary with this message, shame on them and they should be removed for being a special kind of stupid.

And on a side note COL Ted Mc, if you want a discussion, I suggest, sir, that you refrain from making an inflammatory opening such as the title to this post.

Throwing a flash-bang into a room is NOT conducive to a productive conversation with the room's occupants.

COL Ted Mc Wow! I have never seen this article, but the State and Defense Department should not working against each other.
