Is it considered fraternization to move out of barracks to an apartment as a NCO with a E3?

I am trying to move off post to an apartment with my buddy who is a PFC. My platoon sgt says he can't stop me but because I am looking to get promoted soon he said I could get in trouble for fraternization. Is this true? or considered discrimination if he punished me for it?

Problem solved according to AR 600-20 Paragraph 4-14B unless your personal relationship was brought into the work place and can be considered unprofessional there is no problem.
"Ongoing business relationships between officers and enlisted personnel, or NCOs and junior enlisted Soldiers.
This prohibition does not apply to landlord/tenant relationships or to one-time transactions such as the sale of an
automobile or house, but does apply to borrowing or lending money, commercial solicitation, and any other type of
ongoing financial or business relationship."

Its fratenization if you both are in the same chain of command, ie your in charge of the other or the other is in charge of you, thats when you might find some trouble

AR 600–20 4–14. Relationships between Soldiers of different grade:
c. Certain types of personal relationships between officers and enlisted Soldiers, or NCOs and junior enlisted Soldiers, are prohibited. Prohibited relationships include the following:
(2) Dating, SHARED LIVING ACCOMMODATIONS other than those directed by operational requirements, and intimate or sexual relationships between officers and enlisted personnel, or NCOs and junior enlisted Soldiers. This prohibition
does not apply to the following:
(b) Situations in which a relationship that complies with this policy would move into noncompliance due to a change in status of one of the members (for instance, a case where two junior enlisted members are dating and one is subsequently commissioned or selected to be a WO, commissioned officer, or NCO). In relationships where one of the
enlisted members has entered into a program intended to result in a change in his or her status from enlisted to officer or junior enlisted Soldier to NCO, the couple must terminate the relationship permanently or marry within one year of the date of the appointment or the change in status occurs.

I would not interpret section (b) as sign a lease before one of you becomes an NCO. Your knowledge that your relationship will become non-compliant could adversely impact you, because it is your responsibility to prevent non-compliance, not intentionally seek it then interpret the regulation in a way that supports you. I agree with SFC Michael Hasbun. Ask your chain of command and for legal advice, contact JAG. Rule of thumb is if you have to ask, don't do it (in regard to ethics). You're not being discriminated against. Your chain of command are enforcing the standard.

No problem until you get promoted- if you are in the same unit- then it could be fraternization- being charged would not be discrimination- it's call following regs. Evidently you should study some more before getting promoted.

Any perception of perceived favoritism or personal gain among others makes such relationships inappropriate. Your buddy slipping up and calling you by your first name is all it takes for someone to question the relationship and or your unit's good order and discipline. While it might not seem like a big deal - it is. Listen to your PSG advice.
