In your opinion what do you think of the UCMJ having input in a sm's sex life?

It is my understanding that the Uniform Code of Military Justice governs the manner in which the sm can have sexual relations with ones spouse. Is this fair to the family. I personally think that what goes on between a husband and wife is none of any ones business but theirs, so long as it is consensual. Does anyone else think that the private lives of soldiers is being invaded by this regulation? Would really like to hear from any JAG Officers out there about this.

If everything is consensual, then nothing should be getting brought up to UCMJ so i don't believe it is. It's there to state a moral stance and assist anyone being abused/misused in situations.

Anything my wife and I do in our bedroom is consensual. The Army Reserve doesn't know about it. You know why? I don't talk about it. It's none of anyone's business.

Now, if my commander came to me and demanded to know details of my sex life with my wife...that'd be a problem. I don't know ANY commander who would be stupid enough to try that, though.

So basically, it's a non-issue. Yes, Article 125 prohibits sodomy, and oral sex is considered sodomy, but do you really think a commander is going to ask his married soldiers "Hey, you didn't get a blowjob from your wife, or go down on her, did you?""

Really? That'd go over like a lead ballon.

The effect of several cases and changes on the law stated above are on point.<div>There are, however, several ways the military still might intrude into the marital bedroom.<div>1.  The wife alleges a sexual assault.  We are seeing an increased number of these cases with the media attention to sexual assaults.  Most times, there is a connection to marital discord, adultery, and messy divorce (with associated child custody issues).</div><div>2.  There is a third party present and either watching or involved.  And people talk about it, and sometimes have video which gets public (or talked about on social media).</div><div>3.  And if a commander or CID ever want to talk about any of the issues I have listed above - tell them you have nothing to say - it's called exercising your Article 31 rights.  Don't do as quite a few people think and talk because you are innocent and by talking believe you can convince them you are innocent.  Unfortunately it doesn't work that way.</div></div>

I think the sodomy bit was the military's way of barring homosexuals from the services. Since that has been repealed the UCMJ had to be adjusted. The other thing is if idiots kept their sex lives to themselves and thier partners and stuck to consensual relationships there wouldn't be any way to apply the UCMJ to it.
