If you have a Staff Sergeant that has a date of rank prior to 2008, is that SSG Grandfathered in for his ETS which exceeds his RCP?

ARMY MILPER Message 14-070 issued 14 March 2014 superseded MILPER message 11-096 dated 25 March 2011. The aforementioned message expires 2 years from the issue date. If you have a Staff Sergeant that has a date of rank prior to 2008 is that SSG Grandfathered in for his ETS which exceeds his RCP? Where can that information be found? PAY IT FORWARD!!!

I believe his RCP, overrides the ETS, since he hasn't progressed in rank. I am assuming he is at or near 20 years,

I fell under this clause. Since I was indefinite, my ETS date was my RCP so am allowed to serve out to 23 years. Here's what I found.

8. SOLDIERS NOT UNDER THE PROVISIONS OF PARAGRAPH 6 AND 7 OF THIS MESSAGE, AND WHO
WILL EXCEED THE NEW RCP FOR THEIR CURRENT RANK ON THE EFFECTIVE DATE OF THIS POLICY
MESSAGE MAY SERVE UNTIL HIS/HER CURRENT ETS DATE, IF OTHERWISE QUALIFIED. (THIS DOES
NOT APPLY TO SOLDIERS REDUCED IN RANK.)

If this helps, right before I retired in '12,i believe the RCP for SSG was 20 years maybe 22.

He will be grandfathered, as I was. I have 22 years, Mt RCP is next year at the 23 year mark.

Look on his ERB and LES they will show the end dates at 23 years if he is grandfathered.

Yes he is Grandfathered, unless he is reduced in rank, found in para 2, in 14-070: SOLDIERS SERVING IN THE REGULAR
ARMY (RA) AND TITLE 10 ACTIVE GUARD RESERVE (AGR) PROGRAM WHO EXCEED THEIR RCP,
WILL SERVE TO THEIR CONTRACTUAL EXPIRATION TERM OF SERVICE (ETS) DATE UNLESS
THEY ARE REDUCED IN RANK, REMOVED FROM A CENTRALIZED PROMOTION LIST OR
CLASSIFIED IN SPECIAL REPORTING CODE (SRC) 09U.

I have a question in this vein as well. I am at 19+ years. I have a retirement packet in. My ETS is at 23 years but my RCP, like that of all Staff Sergeants, is 20 years. I WANT to retire and have a packet submitted. I have been told that the Colonel might deny the retirement because the unit is short of Staff Sergeants and I am needed for a deployment next year.

Are we all tied to my RCP, or can the Brigade Commander deny my retirement because my ETS is not until 2020?

Are you still eligible for the E7 board if you are grandfathered in with 18.5 years time in service?
