If I separated from AD after 4 years, had a 5 year break in service before returning AD, does my prior 4 count towards legacy retirement?

Was in the navy 4 years, got out as an E-5 in 2016, commissioning active duty Army effective 2021 so a 5 year break in active service. Heard somewhere for the legacy retirement system you have to have 20 consecutive years as opposed to just doing 16 until I am eligible. Any insight would be greatly appreciated.

You’re grandfathered in. When they give you the option opt into the legacy retirement plan.

All active duty time is counted for an Active Duty retirement. Your BASD will be calculated to credit you the time. If you commission in 2021, your BASD will be 2017, you'll be eligible to retire in 2037. You're already in the High 3 retirement, it's not called Legacy. When you commission you are eligible to opt in to the BRS for one year after you come onto active duty.

If you have OVER four years active duty then you will be on the OE pay scale, that means 4 years +1 day at least. You should have had an MSO when you separated and the IRR time counts toward your PEBD. So when you start getting paid you'll be getting paid as having almost 8 years of service - DEP time doesn't count toward your PEBD.

You simply need 20 years of active service to get the retirement. This is cumulative. Since you served prior to 31Dec17 you will remain on the high 3 retirement unless you opt into BRS. If you have more questions on blended retirement or high 3 use google there is a lot of good info out there.

No amount of service is legacy, all service counts towards retirement.
