My chain told me two weeks ago that I had to clear. Is this legal? Do I get severance/sep pay? What are my options? If I ETS due to hitting my RCP, do I get severance or separation pay?2020-11-11T19:00:43-05:00SGT Private RallyPoint Member6490395<div class="images-v2-count-0"></div>I’m a SPC about to ets under RCP. Should have thought about that before the bust. There is no separation pay/severance pay in the service. You get accrued leave, rats, BAH, etc. You really have no other options but to start clearing before the unit starts clearing you. Once you were reduced you should have had your ETS date adjusted to 180 days from the date you were notified of your new ETS if you were already past RCP. Your Career Counselor is responsible for changing your ETS and counseling you. You can't change that you have a new ETS without promoting again, but you are due 180 to transition.<br /><br />As for severance pay, the 8G code your Career Counselor will place on you prevents you from receiving severance pay. If they mess up and forget to place it on you, and you receive severance pay, a future audit will force you to repay all of the money at the pretax amount. In other words, you would probably rate around 30-40k in severance pay but receive 22-30k after taxes. You would be required to pay back the pretax amountResponse by SFC Private RallyPoint Member made Nov 11 at 2020 10:44 PM2020-11-11T22:44:08-05:002020-11-11T22:44:08-05:00SSG Private RallyPoint Member6490896<div class="images-v2-count-0"></div>Never heard of someone getting busted down and still thinking they are owed something.
